<br />project because of the water regulation effect such a reservoir <br />woulo have on the flows of the river. <br /> <br />In the Upper Unit, water would be diverted just west of <br />Ft. Morgan and-piped to Fremont Butte reservoir about eight miles <br />northwest of ~kron. Also, water would be diverted through the <br />Prewitt reservoir enlargemeqt and piped to Fremont Butte <br />reservoir. The North Sterling pump plant and pipeline may also <br />be used for the benefit of the district by pumping water into the <br />existing North Sterling reservoir inlet, east of Sterling, to <br />eliminate approximately 30 miles of canal and take full advantage <br />of return flows in the river reach from Balzac to Sterling. From <br />Fremont Butte reservoir, water would be re-stored and/or <br />distributed for use in the Northern, Central, and Southern W-Y <br />reservoirs, through the High Plains, NOrthern W-Y, and Southern <br />W-Y canals. <br /> <br />In the Lower Unit, water would be diverted near Sedgwick <br />and piped over the basin divide for storage in the Marks Butte <br />and Phillips-Sedgwick number one and two reservoirs. <br />Subsequent distribution would be by the Phillips-Sedgwick canal <br />and lateral. <br /> <br />Through the Internal Management Plan, the project would <br />capture precipitation runoff, usually from heavy storms in the <br />project area, and distribute it through the proposed facilities <br />for di rect use or possible ,ground recharge. <br /> <br />WATER RIGHTS <br /> <br />The South Platte River diversioni and all associated <br />storage and conveyance facilities were conditionally decreed by <br />the water court for Water Division 1 on June 8, 1978, in Case <br />Number W-8103. The apPlication, filed in December, 1975, was <br />decreed with a priority date of July 10, 1975. Decreed uses <br />include irrigation, domestic, municipal, commercial, industrial, <br />power generation, recreation, piscatorial, exchange, <br />substitution, replacement, augmentation, and recharge, including <br />rights of use and reuse of all trans-basin return flows and waste <br />waters, and for all other beneficial uses. <br /> <br />Application for a conditional water right for the Internal <br />Management plan was filed with the water court for Water Division <br />1 in December, 1977, in Case Number W-g755. A decree was <br />entered by the water judge on April 12, 1982. This right will <br />provide variable amounts of water, depending on weather <br />conditions and precipitation, with priority dates of December <br />27-30, 1977. Decreed uses are the same ,as listed above. <br /> <br />-2- <br />
