<br />677 <br /> <br />I <br /> <br />and all matters pertaining to the administration of this <br />Article and the protection and conservation of the ground- <br />water resource of the designated Tentatively Critical or <br />Critical District. It shall be the responsibility of the <br />district advisory board to give full consideration to any <br />and all matters pertaining to ground water within its dis- <br />trict and to make every effort to reach satisfactory solu- <br />tions to those matters at the district level. If satisfac- <br />tory solutions are reached at the district level, the mat- <br />ters need not be taken to the Water board; however, nothing <br />herein shall prevent the district advisory board's calling <br />attention of the Water board Or the State Engineer, or both, <br />to any matter deemed necessary to the proper administration <br />of this Article or the furtherance of the purpose of this <br />Article. <br /> <br />Section 147-18-7. From and after the "date this <br />Article becomes effective, no new use of ground water in <br />Colorado shall be made, nor existing use increased or ex- <br />tended, unless the user sha 11 make an application in writ- <br />ing to the State Engineer, fo! a "Permit to Use Ground <br />Water", setting forth information required by section 147-18-4. <br /> <br />Upon receipt of an application for a new, increased <br />or additional use of ground water from a ~on-restricted area, <br />or from a non-restricted aquifer in a restricted area, accom- <br />panied by a filing fee of ten dollars, the State Engineer <br />shall issue a "Permit to Use Ground Water". The permit shall <br />set forth such conditions for drilling, casing and equip- <br />ping wells and other diversion facilities as are reasonably <br />necessary to prevent waste or pollution of water and injury <br />to existing rights. The State Engineer shall endorse upon <br />the application the date of its receipt, file and preserve <br />such application and make a record of such receipt and the <br />issuance of the permit in a book kept in his office fo: that <br />purpose and so indexed as to be useful to water users ln de- <br />termining the extent of claims made to various ground water <br />sources. <br /> <br />I <br /> <br />Whenever it appears from an application or other <br />sources of information that there is insufficient ground <br />water available in any of the aquifers under any unrestricted <br />area to support additional USes therefrom, the State Engineer <br />shall request the Water board to determine if the area should <br />be designated as a restricted district. The Water board shall <br />notify the State Engineer as to its determination as soon as <br />practicable and feasible. If the area is not designated as <br />restricted, the State Engineer shall proceed to process re- <br />quests for permits in the customary manner. <br /> <br />Section 147-18-8.
