WHEREAS, the Service has requested an additional amount of water from Ruedi Reservoir
on a temporary basis to study and evaluate the effects of such additional water on the habitat of
the endangered fish in the IS-mile reach and to preserve the habitat of the endangered fish to a
reasonable degree; and

WHEREAS, Reclamation can make additional water available for such purposes on a

temporary basis without interfering with the long-term Ruedi Reservoir Round II water

marketing program; and

WHEREAS, Reclamation, the Service, and the Board will benefit from the study and

evaluation ofthe effects of the releases of water from the regulatory capacity of Ruedi Reservoir

on the important habitat of endangered fishes in the IS-mile reach and will contribute to

progress under the Recovery Program.

NOW, THEREFORE, in consideration ofthe mutual covenants hereinafter set forth, the
parties hereto agree as follows:

I. DEFINITIONS

Where used herein, unless specifically expressed otherwise or obviously inconsistent with the
intent thereof, the term:

a. "Contracting Officer" shall mean the Regional Director, Great Plains Region, Bureau of
Reclamation. Unless stated otherwise, the Contracting Officer shall be deemed to be the
Secretary's authorized representative.
