<br />, <br /> <br />e <br /> <br />WHEREAS, the Service has requested an additional amount of water from Ruedi Reservoir <br />on a temporary basis to study and evaluate the effects of such additional water on the habitat of <br />the endangered fish in the IS-mile reach and to preserve the habitat of the endangered fish to a <br />reasonable degree; and <br /> <br />WHEREAS, Reclamation can make additional water available for such purposes on a <br /> <br />temporary basis without interfering with the long-term Ruedi Reservoir Round II water <br /> <br />marketing program; and <br /> <br />WHEREAS, Reclamation, the Service, and the Board will benefit from the study and <br /> <br />evaluation ofthe effects of the releases of water from the regulatory capacity of Ruedi Reservoir <br /> <br />on the important habitat of endangered fishes in the IS-mile reach and will contribute to <br /> <br />progress under the Recovery Program. <br /> <br />e <br /> <br />NOW, THEREFORE, in consideration ofthe mutual covenants hereinafter set forth, the <br />parties hereto agree as follows: <br /> <br />I. DEFINITIONS <br /> <br />Where used herein, unless specifically expressed otherwise or obviously inconsistent with the <br />intent thereof, the term: <br /> <br />a. "Contracting Officer" shall mean the Regional Director, Great Plains Region, Bureau of <br />Reclamation. Unless stated otherwise, the Contracting Officer shall be deemed to be the <br />Secretary's authorized representative. <br /> <br />e <br /> <br />5 <br />
