William McDonald <br />Page 6 <br /> <br />Therefore, I urge the Board to reconsider its position, and to <br />defer making a recommendation as to the resolution of these cases <br />until the Board has had the opportunity to review the State's <br />technical analysis, to study the impacts of the claims on vested <br />water rights and future development, to consider the relative <br />strengths and weaknesses of the Forest Service's case, and to <br />weigh carefully the benefits of a negotiated settlement compared <br />to the possible outcome of litigation. I expect that the Board <br />would be in a position to review this matter after depositions <br />are completed, probably by February 1989. <br /> <br />If you would like, I can have Deputy Attorney General Lois Witte <br />attend your special session in August.
