J. William McDonald
Page 6

Therefore, I urge the Board to reconsider its position, and to
defer making a recommendation as to the resolution of these cases
until the Board has had the opportunity to review the State's
technical analysis, to study the impacts of the claims on vested
water rights and future development, to consider the relative
strengths and weaknesses of the Forest Service's case, and to
weigh carefully the benefits of a negotiated settlement compared
to the possible outcome of litigation. I expect that the Board
would be in a position to review this matter after depositions
are completed, probably by February 1989.

If you would like, I can have Deputy Attorney General Lois Witte
attend your special session in August. At that time, we should
have had an opportunity to discuss this matter with all parties,
and will be able to determine if there is consensus to proceed as
recommended by the Board.

Sincerely,

#"".a",~ ~

DU!\NE l'iOODARD
Attorney General

DW:tm

AG Alpha No. LW FR HRDJ
AG File No. CNR8803906/BW

.

.

.
