<br />townsite or right-of-way along the Denver and Rio Grande Railroad. which <br />is claimed by Ouray County, would not affect the state highway invita- <br />tion. <br /> <br />MR. SPARKS: , I have consulted with the Attorney General's office con- <br />cerning this matter, and we have the Regional Solicitor here. I keep <br />getting different stories. I was once told that th~ Highway Department <br />could move if a certain percentage of the right-of-way had been secured. <br />I was never given to understand that we had to have 100 percent jn hand <br />for the issuance of bids. <br /> <br />I <br /> <br />Now, will the solicitor tell me about his understanding of the policy <br />of the State Highway Department? <br /> <br />MR. NIELSON: I can't respond to what that is with respect to percentages, <br />Larry, except to say that I ~as told that we had to have all the right- <br />of-way secured for the stretch of highway associated with the relocation <br />before they would be willing to go ahead with a bid procedure. <br /> <br />I might add to that, that we met with the united States Attorney in <br />Denver three days ago, and we were just about ready to issue or to file <br />a condemnation action. I think we are just two or three days away from <br />it. <br /> <br />MR. SPARKS: But the condemnation has not yet been filed? <br /> <br />MR. RINCKEL: It could have been filed yesterday' or today. <br /> <br />MR. SPARKS: Knowing how the Justice Department operates, tha~ may be <br />months away yet. I don't know. I'm a little disgusted at the whole <br />damn proceedings: <br /> <br />But let'.s assume that now we are going to be delayed. This highway <br />relocation probably now cannot be accomplished this year. And each day <br />that goes by, we are losing a good part of the best part of the working <br />year. <br /> <br />So let's assume thqt this highway relocation cannot be completed until <br />next year under what is happening today. How will this affect the issu- <br />ance of specifications and bids for the dam itself? <br /> <br />MR. CARLSON: It is our anticipation to construct Ridgway Dam in two <br />phases, with the Stage One construction consisting of the excavation for <br />the foundation, preparation of the foundation, refill back to original <br />ground, and the construction of the outlet works facility. <br /> <br />The second stage of construction ~ould consist of constructing the <br />embankment itself, the dam itself, and the spillway facilities. <br /> <br />I <br /> <br />It is my opinion that whether or not the state highway proceeds, this <br />construction season will not ~ignificantly alter the method in which we <br />construct Ridgway Dam or change the timing. There is a possiblity that <br />the construction, if it was to start -- the highway construction -- if <br />it was to start this year, would have alleviated some relocation or <br />detouring in the dam area. But this is problematical as to whether or <br />not this would have geared together just exactly right. <br /> <br />-16- <br />
