The Applicant has agreed to the following terms and conditions: <br /> . Colorado River from Granbv Reservoir to the Fraser River: In the event that the CWCB's instream <br /> flow water rights are not met within this reach, the Wolford Mountain replacement water provided <br /> for hereunder shall not be utilized as an additional water supply source. This limitation shall only <br /> apply to the Middle Park Contractees whose diversions affect this reach of the river and only during <br /> the periods when said instream flow rights are not fully realized. <br /> . Colorado River from the confluence of Fraser River to the confluenee ofMuddv Creek: In the event <br /> that the CWCB's instream flow water rights or other water rights are not met within this reach, the <br /> Wolford Mountain replacement water provided for hereunder shall not be utilized as an additional <br /> water supply source. The decree provides that pursuant to section 37-92-30S(S), C.R.S., the State Engineer shall curtail all <br /> out-of-priority diversions, the depletions from which are not so replaced as to prevent injury to <br /> vested water rights. <br /> ISF SubcommIttee Meeting: The first meeting of the Board's Instream Flow Subcommittee was held in <br /> Denver on Oct. 13. The Subcommittee was created by the Board in March 2005 to address policy and <br /> procedural issues that were identified through the Stream and Lake Protection Section's Strategic <br /> Planning effort. The Subcommittee members include: <br /> Tom Sharp, Yampa-White Director <br /> Harold Miskel, Arkansas Director <br /> John Redifer, Colorado Director <br /> Keith Catlin, Gunnison Director <br /> Barbara Biggs, Denver Director <br /> Don Schwindt, San Juan, Dolores, San Miguel Director <br /> Eric Wilkinson, South Platte Director <br /> The topic for this first meeting was IdentifYing and Prioritizing Environmental and Recreational Needs. <br /> Subcommittee members and CWCB staff discussed procedures for requesting and considering instream <br /> flow recommendations. Staff proposed extending the recommendation process to allow additional time <br /> for public notice and comment. Subcommittee members requested staff to draft written procedures and a <br /> timeline for the Subcommittee's review at the next meeting. <br /> . The Subcommittee also discussed procedures and criteria for identifYing and prioritizing environmental <br /> needs in the state. Staff presented examples of criteria adopted by previous boards, as well as examples <br /> of tools currently being used by Colorado conservation groups and other stales to identi1}r and prioritize <br /> 31 <br /> <br />. <br />
