The CWCB and the Applicant have agreed to the entry of a decree that will prevent injury to the Board's
ISF water rights listed above. The Applicant has agreed to the following terms and conditions:
. Colorado River from Granbv Reservoir to the Fraser River: In the event that the CWCB's instream
flow water rights are not met within this reach, the Wolford Mountain replacement water provided
for hereunder shall not be utilized as an additional water supply source. This limitation shall only
apply to the Middle Park Contractees whose diversions affect this reach of the river and only during
the periods when said instream flow rights are not fully realized.
. Colorado River from the confluence of Fraser River to the confluenee ofMuddv Creek: In the event
that the CWCB's instream flow water rights or other water rights are not met within this reach, the
Wolford Mountain replacement water provided for hereunder shall not be utilized as an additional
water supply source. This limitation shaI1 only apply to the- Middle Park Contractees whose
diversions affect this reach of the river and only during the periods when said instream flow rights

. The decree provides that pursuant to section 37-92-30S(S), C.R.S., the State Engineer shall curtail all
out-of-priority diversions, the depletions from which are not so replaced as to prevent injury to
vested water rights.
ISF SubcommIttee Meeting: The first meeting of the Board's Instream Flow Subcommittee was held in
Denver on Oct. 13. The Subcommittee was created by the Board in March 2005 to address policy and
procedural issues that were identified through the Stream and Lake Protection Section's Strategic
Planning effort. The Subcommittee members include:

The topic for this first meeting was IdentifYing and Prioritizing Environmental and Recreational Needs.
Subcommittee members and CWCB staff discussed procedures for requesting and considering instream
flow recommendations. Staff proposed extending the recommendation process to allow additional time
for public notice and comment. Subcommittee members requested staff to draft written procedures and a
timeline for the Subcommittee's review at the next meeting.
. The Subcommittee also discussed procedures and criteria for identifYing and prioritizing environmental
needs in the state. Staff presented examples of criteria adopted by previous boards, as well as examples
of tools currently being used by Colorado conservation groups and other stales to identi1}r and prioritize
