Box 168 <br />Breckenridge, CO 80424 <br /> <br />Dear Mayor and Town Council Members: <br /> <br />Thank you for meeting with the CWCB staff and me at your June 13, 2000 Work Session to <br />discuss settlement of Case No. 97CW283. While we had understood that the meeting would be <br />open to the public and were not comfortable with the exclusion of the public from the room, we <br />felt that the meeting was productive and appreciated the opportunity to directly discuss the case <br />with Town Council members. <br /> <br />We commend the Town's diligent environmental stewardship of the Blue River and of the <br />Breckenridge area in general, and welcome the opportunity to work in partnership with the Town <br />to achieve our common goal of protecting the Blue River. We were very pleased to hear that the <br />Town places a high priority on maintaining flows in the Blue River at least in the amounts of the <br />CWCB's decreed instream flow water rights. At the same time, I believe the CWCB must <br />recognize the Town's concerns regarding its water supply in the event ofa prolonged drought and <br />be willing to work with the Town to insure its water supply during severe drought conditions. <br /> <br />My understanding from our meeting is that the Town and the CWCB may be able to <br />resolve this case by entering into an agreement under which the Town would operate its <br />proposed exchange when the CWCB's Blue River instream flow amounts (decreed in Case Nos. <br />86CW204 and 86CW217) are satisfied. At times when those instream flow amounts are not met, <br />the Town would curtail its exchange and would donate the water diverted from Miners Creek to <br />the CWCB for instream flow purposes. Further, it is my understanding that the Town would <br />specify circumstances (such as severe drought conditions) under which it could operate its <br />exchange when Blue River stream flows are less than the amounts decreed to the CWCB. <br /> <br />At the July CWCB meeting, I will report on our meeting to my fellow Board members <br />and encourage them to work with the Town toward resolution of this case. In the meantime, the <br />CWCB staff and the Attorney General's Office will work with the Town on the specifics of such <br />resolution, <br /> <br />Sincerely, <br /> <br />R.
