South Platte River F100dpliin Project, Right-of-Way Action

lNTRODUCTION

At the November 6-7, 1995, Board Meeting, approval was given to grant requests for eaSements
in CWCB's right-of-way along the Chatfield Downstream Cbannel Improvement Project on a
cllse.by~case basis. The Board has received a request from the Mountain Miser Kayak School for
an easemept over land owned by the CWCB as part of the Project, adjacent to the South Platte
River to use the land to access and exit the River as part of the School's kayaking classes. The ,
School will conduct these classes through the Board's Union Avenue boat chutes. See"
Attachment A.

DISCUSSION

The Mountain Miser Kayak School requests an easement for ingress and egress to/from the South
Platte River m connection with conducting kayak classes through a 900 foot stream reach of the
South Platte River channel. The instructors and students will access the river reach through
designated ingress and egress points. There are a number of CWCB project features and
previous easements granted within the requested easement area.

Use for the Requested Area is for ingress and egress to/from the Riuver at designated points
along the River as part of conducting kayaking classes from April 1 through October .1 of each
year. If granted, the easement will not restrict any future easements/activities within the eWCB
project ROW.

Conditions for the Easement - If the easement is granted, the grantee shall comply with the
following conditions:

TIME PERlOD - The EASEMENT shall be for a term of 5 years with renewal
provisions.
