<br />e <br /> <br />f. CWCB Hearing Officer. The Hearing, Officer is appointed by the Board and is <br />responsible for managing and coordinating proceedings related to contested ISF <br />appropriations, such as setting prehearing conferences and adiusting deadlines and <br />schedules to further the Parties settlement efforts or for other good cause shown. The <br />Hearing Officer does not have the authority to rule on substantive issues. <br /> <br />~. 7 Contested Hearim: StalllS: <br /> <br />g. Partv Status. Any person may apply for Party status pursuant to Rules 5.1. and S.m. <br />Only a person who has applied for and received Party status may submit, for the <br />record, technical evidence, technical witnesses or legal memoranda. Each Party is <br />responsible for mailing copies of all documents to all other Parties and Contested <br />Hearing Participants. <br /> <br />h. Contested Hearing Participant Status. Any person who desires to participate in the <br />contested ISF process, but not as a Party, may apply for Contested Hearing Participant <br />status pursuant to Rule S.m. A person with such status will receive all Party <br />documents. Contested Hearing Participants may comment on their own behalf, but <br />may not submit for the record technical evidence, technical witnesses or legal <br />memoranda. <br /> <br />e <br /> <br />1. Final Staff Recommendation. Staffs instream flow recommendation to the Board <br />based on Staffs data and report and public comments and data contained in the <br />official record. <br /> <br />J. Final Action. For purposes of Rule 5, final action means a Board decision to (1) file a <br />water rights application, (2) not file a water rights application or (3) table an ISF <br />recommendation. <br /> <br />1.10 Mailiag Lists. <br /> <br />k. Agenda Mailing List. The agenda mailingilist consists of all persons who have notified <br />the Board Office that they are interested ih all or part of the activities of the CWCB. <br />These persons are mailed a Board meeting agenda prior to each scheduled Board <br />meeting. Names remain on this list indefinitely or until the person requests to have <br />their name removed from future mailings. <br /> <br />1. ISF Subscription Mailing List. The ISF Subscription Mailing List shall consist of all <br />persons who have subscribed to the list by notifying the Board Office.
