<br />, <br /> <br />e <br /> <br />e <br /> <br />e <br /> <br />c) A site-survey ofthe property covered by the proposed easement. <br /> <br />d) A copy of a letter noticing the following parties of the intent to apply for an easement: the <br />Corps of Engineers-Omaha District, Urban Drainage and Flood Control District, South <br />Suburban Parks and Recreation District and the CWCB-Flood Protection Section, <br /> <br />e) A demonstrated awareness of and compliance with the pertinent environmental regulations and <br />floodplain permits, <br /> <br />f) For aJI drainage easement requests, a completed site drainage study and plan. <br /> <br />g) Easement requests within the Project Flood Conveyance Lands must include a hydraulic <br />analysis to show impacts on the flood conveyance for the improved flood channel. <br /> <br />5. Any and aJI easements granted shall be temporary in nature and are revocable. <br /> <br />6. The CWCB may charge fees for easements, in accordance with the CWCB fee structure for project <br />easements that he CWCB approved on March 13, 1996, See attached document for Easement Fee <br />Structure. <br /> <br />7. The CWCB may detennine that the benefit to the State would be best served by a waiver of all or <br />part of the fees otherwise charged for an easement and upon making such findings may waive aJl or <br />a part of such fees. <br /> <br />8, In determining whether or not to grant an easement and in determining value, the CWCB may <br />consider the following factors: <br /> <br />A. Whether the requesting party is: <br />1) Governmental body, <br />2) Private governed utility, or <br />3) Private entity. <br /> <br />B, Whether the area under, upon, or over which the easement is requested is: <br />1) An undeveloped area that never will be developed, <br />2) An undeveloped area held primarily for future development, <br />3) Developed area with minimal usage, <br />4) Developed area with heavy usage, or <br />5) Developed area with year round usage. <br /> <br />C, Whether use of the easement by the requesting party would <br />1) Terminate, restrict or require a change in the use of property by the CWCB, or <br />2) Require maintenance and repairs that would interfere with the use of property by the State. <br /> <br />D. Whether the granting of the easement will adversely affect CWCB functions or programs <br />directly or indirectly related to the easement property. <br /> <br />E. Whether the granting ofthe easement is in the best interest ofthe CWCB and the State of <br />Colorado, <br />
