<br />Colorado Water Conservation Board <br />Flood Protection Section <br />Easement Guidelines <br />July 2001 <br /> <br />Backl!round . <br />The Colorado Water Conservation Board has been receiv~ng and acting on requests for easements on <br />land owned by the CWCB as part of the South Platte River Channelization Project. The Board <br />requested that staff develop guidelines to assist with the administration of easement requests for the <br />property owned by CWCB, <br /> <br />In the 1980's, the United States Army Corps of Engineers ("Corps") constructed the South Platte River <br />Channelization Project, consisting of improvements to tl1e flow of water in the channel of the South <br />Platte River in Arapahoe County to provide drainage, fldod control and water flow regulation known <br />as ("Channelization Project"), As part of its participation in the Channelization Project, the CWCB <br />currently owns and controls approximately 7 miles on the South Platte River floodplain in Littleton, <br />Colorado, The CWCB's management of this land is subject to the terms ofthe September 7,1977 and <br />January 29,1980 Agreements ("Corps Agreements") between the CWCB and the Corps, which <br />obligate the CWCB to operate and maintain the improv~ments, <br /> <br />The Board has received easement requests from utility companies, special districts, developers, <br />engineers, municipalities, environmental and recreation(ll groups and individuals, In evaluating such <br />easement requests, the CWCB shall use the following guidelines, <br /> <br />1. No easement shall be granted except by action of the CWCB at a regularly scheduled board <br />meeting, . <br /> <br />2. The CWCB shall evaluate all easement requests in light of its obligations under the Corps <br />Agreements, with the top priority being flood proteption and public safety. No easement may <br />interfere with flood protection and public safety, <br /> <br />3, For all easement requests, the CWCB shall consider impacts to the South Platte River conveyance <br />lands as part of its obligation to maintain the flood ponveyance of the enlarged channel under the <br />Corps Agreements, Exhibit A shows the Project R~creation Lands and Flood Conveyance lands, <br />The CWCB has granted an easement for certain re~reational activities to the South Suburban Park <br />and Recreation District, Littleton, Colorado, <br /> <br />4, Formal easement requests submitted to the CWCB must include: <br /> <br />.. <br />t <br /> <br /> <br />e <br /> <br />e <br /> <br />a) Full name, address and contact information ()fthe grantee, and information regarding all <br />interested parties and affiliates of the grantee, . e <br /> <br />b) A detailed explanation of the proposed purposb and users) of the easement. <br />
