Permits to construct wells outside designated arcas . fees - permit <br />no ground water right. evidence - time limitation. (1) From and after May <br />17. 1965. no new wells shall be constructed outside the boundaries of a desig- <br />nate<l ground water basin. nor the supply of water from existing wclls outside <br />the bounuarics of a tlcsignatcd gruund water busin incrcascu or cxtcnucu, <br />unless lhe user makes an application in writing to the state engineer for a <br />"permit to constroct a well". in a form to be prescribed by the state engineer. <br />The applicant shall specify the particular dcsignated aquifer from which the <br />water is 10 he divcrted. Ihe hencficial use to which il is proposed lO apply <br />such water, the location of the proposed well. the name of the owner of <br />the land on which such well will be loca:ed. the average annual amount of <br />water applied for in acre-feet per year. the proposed maximum pumping rate <br />in gallofl!\ per minule, anu. if the proposeu use is irrigalion, a ucscriplion <br />of the land to he irrigatcd and the namc uf the owner thcreof, together with <br />such other reasonable information as the state engineer may designale on <br />the form prescribed. . <br />(2) Upon receipt of an application for a replacement well or a new, <br />increllSed. or additional supply of ground :-vater from an area outside the <br />hounuarics ur a dcsignalcu gruund waleI' basin. accornpanicu by a filing fee <br />of twenty-five <lollars. the stale engineer shall make a determination as to <br />whether or not the exercise of lhe rcquested permit will materially injure <br />the vested water rights of others. If the state engineer finds that there is <br />unappropriated walcr availahle for wilhdfilwal hy the proposed wcll and Ihat <br />the vestcd water righls of uthers will nut be nlaterially injured. and can be <br />substantiated by hydrological and geological facts. he shall issue a permit <br />to construct a well. hul nol othcrwisc: cxccpl lhat no permit shall he issued <br />unlcss the loc;ltiun of Ihc proposcd well will bc at a distancc of mure than <br />six hondrcd fcct fmm an cxisting well. hul if the state cngineer. aflcr a hear- <br />ing. finds Ihat circumstances in a particular instance so warrant. he may issue <br />a permit withoul rcgard to lhe above limitation.
