<br />1 general assembly hereby determines that, for the purpose of <br /> <br />2 aiding ,and preserving unto the state of Colorado and all its <br /> <br />3 citizens the use of all the GROUND WATERS AND waters of the <br /> <br />4 springs, lakes, ponds, creeks, rivers, streams, and <br /> <br />5 watercourses of this state, which waters do not increase with <br /> <br />6 the growth of population and which are necessary for the <br />7 health and prosperity of all the citizens of the state of <br /> <br />8 Colorado, and for the growth, maintenance, and general welfare <br />9 of the state. it is unlawful for any person, corporation, or <br />10 association to divert, carry, or transport by ditches, canals, <br />11 pipes, conduits, natural ~treams, or watercourses the GROUND <br /> <br />12 WATERS OR waters of any spring, reservoir, lake, pond, creek, <br /> <br />13 river, stream, or waterc~urse of this state into any other <br /> <br />14 state for use tnerein. Whe~e the same owner of agricultural <br /> <br />15 land in Colorado owns agricultural land in the adjacent state <br /> <br />16 that is contiguous with the agricultural land in Colorado, <br /> <br />17 <br />18 <br />19 <br />20 <br /> <br />specific authorization of the General Assembly, on the advice <br />ofrthe state engineer, is required to enable the water to be <br />used in the adjacent state for agricultural purposes only. In <br />deciding whether or not to authorize the diversion of water <br /> <br />21 from Colorado into another state, the general assembly shall <br /> <br />22 consider the willingness of said state to allow diversions of <br /> <br />23 its water for use in Colorado. <br /> <br />24 SECTION 2. 37-90-136, Colorado Revised Statutes 1973, is <br /> <br />25 amended to read: <br /> <br />26 37-90-136.
