<br /> <br />Wheeler-Case law. <br /> <br />7. The Cherry Creek Flood Control projeot. This projeot <br />has been authorized for several years for oonstruotion by the <br />Corps of Army Engineers. It provides flood oontrol On Cherry <br />Creek to prevent flood damages in the City of Denver and areas <br />adjaoent thereto. It is understood that the Corps of Army Engi- <br />neers proposes to reauest a supplemental budget estilnate to <br />initiate construotian of this project during the present fiscal <br />year. <br /> <br />8. The Colorado Spri s Flood Control and Improvement ro eot. <br />This projeot, under the Corps of my Engineers, has. been author- <br />ized and provides flood protection primarily for the City of <br />Colorado Springs. <br /> <br />9. The San Luis Valley projeot. This projeot has been <br />authorized for oonstruation by the Bureau of Reolamation. It is <br />looated in the Rio Grande Basin to provide supplemental water <br />supplies for presently irrigated lands in the San Luis Valley. <br />It oonsists of two units, namely. (l) the Rio Grande unit. with <br />two prinoipal features.. the Wagon Wheel Gap reservoir for storage <br />of 1,000.000 aore feet of water, and the Weminuohe diversion for <br />exportation of approximately 24.000 aore feet of water per year <br />from the San Juan Basin; and (2) the Conej os unit for the storage <br />and regulation of the water of the Conejos River for supplemental <br />irrigation supplies. The Conejos unit. aooording to present <br />plans. will oonsist of a ohanne1 reservoir on the Conejos River <br />and an off-ohannel reservoir. Water users under the Conejos unit <br />have organized a oonservanoy distriot under the Conservanoy <br />Distriot Aot of 1937. as amended. The formation of a district <br />for the Rio Grande area is being undertaken. <br /> <br /> <br />Provided. that the approval of this project, as a part of <br />the immediate postwar program in Colorado. is subject to the <br />oondition that no oonstruotion of the Weminuche transmountain <br />diversion feature nor effort to secure appropriations therefor <br />shall be undertaken until an agreement for ~he protection of the <br />present and prospeotive uses of water in theSan Juan Basin, <br />pursuant to the polioy heretofore approved by this Board, has <br />been made between the interests in the San Juan Basin and the <br />water users ili the San Luis Valley who will benefit by the pro- <br />posed diversion. Suoh agreement shall be satisfaotory to the <br />affeoted interests in both the San Juan Basin and. the San Luis <br />Valley. and approved by the Colorado WaterConservati.ou Board. <br />All appropriate measures through appropriat:j..Ol1-AotSand other- <br />wise shall be taken to effeotuate this oo~ition, <br /> <br />10. Investigations, All appropriate steps shall be taken <br />by the Board to aid in expediting projeGt.investigations and <br />studies of the Bureau of Reolamation. the Corps of Army Engineers. <br />the U.
