<br />-~ <br /> <br />:.~ <br /> <br />Pueblo's Proposed Terms and Conditions for RICD Water Ril!ht <br /> <br />(July 22, 2002) <br /> <br />1. Amounts: An RlCD water right is approved for each of the 9 control <br />structures identified in Pueblo's application as follows: <br /> <br />March 15 through November 14 of each year - 500 cfs (conditional) <br />November 15 through March 14 of the following year - 100 cfs (conditional) <br /> <br />2. Time of Day for RICD Water Right: The RICD water right in excess of <br />100 cfs shall be in effect during the hours of 6:00am to 1 0:00pm and shall not be in <br />effect during the hours of 10:00pm to 6:00am. <br /> <br />3. Administntion of RICD Water Right: <br /> <br />a. The satisfaction of the RICD water right will be gauged based on the <br />existing USGS stream flow gage at Moffat Street, without reference to any inflow at the <br />Abriendo exit. <br /> <br />b. Pueblo will participate in the cost of operating and maintaining the <br />accuracy of the Moffat Street Gage, and preserving the satellite monitoring capability <br />for the gage, to the extent such costs are not absorbed by the USGS, along with other <br />parties whose water rights are administered through that gage. <br /> <br />c. Pueblo will work with the Division of Water Resources to determine a <br />protocol acceptable to the Division for placing a call for the RICD water right, and <br />establish a contact within the City for coordinating with the Division. <br /> <br />4. Flooding and flood control concerns: When Pueblo Reservoir flood <br />control operations are in effect, or for other good and sufficient reasons in an <br />emergency situation, and the responsible governmental agencies have determined that a <br />flow of less than the RICD rate should be released from the outlet works for Pueblo <br />Reservoir, the RICD water right will not impose a call for water that would require <br />releases from Pueblo Reservoir in excess of that being released under flood control <br />operations. <br /> <br />5. Dry Year Exception: The RICD water right shall not be in effect for any <br />month for which the Natural Resources Conservation Service's Colorado Basin Water <br />
