<br />244 <br /> <br />"OPERATING PlmiCIPLES <br /> <br />"The construction and operation of the project involve the diversion of <br />water from the headwaters of the Fryingpan River and other tributar.ies of the <br />RoarinG Fork River to the Arkansas River Basin. The project contemplates <br /> <br />"(a) The maximum conservation and use of the diverted waters; <br /> <br />"(b) The protection of Western Colorado water uses, both existing and <br />potential, in accordance with the declared policy of the State of <br />Colorado; and <br /> <br />"(c) The preservation of recreational values. <br /> <br />"In order to accomplish such purposes the project shall be operated by the <br />United States in compliance with the Federal reclamation laws, the laws of the <br />State of Colorado relating to the appropriation, use, or distribution of water, <br />and the following operating principles: <br /> <br />"I. As used herein, <br /> <br />"(a) "Project" means that certain enterprise planned and de- <br />signed by the Bureau of Iteclamation, Department of the Interior, for <br />the transmountain diversion of water from the headwaters of the Frying- <br />pan River and other tributaries of the Roarinf3 Fork River to the basin <br />of the Arkansas Itiver, together with all of its appurtenant" works and <br />facilities in both Eastern and Western Colorado. <br /> <br />"(b) "Eastern Colorado" meano that portion of the State of <br />Colorado lying within the natural drainage basin of the Arkansas River. <br /> <br />"(c) "Western Colorado" meanlS that portion of the State cf.Colorado <br />lying lvithin the natural drainage basin of the Colorado River and served <br />by diversions made from the Colorado Hiver, or its tributaries, above its <br />doIfluence with the Gunnison !tiver. <br /> <br />'''(d) "Eastern Colorado Conservancy District" means that entity to be <br />hereafter created to contract for payment to the United States of an <br />appropriate portion of project costs allocated to certain wa~er uses in <br />Eastern Colorado. <br /> <br />"(e) . "Aspen Reservoir" means not only the reservoir presently plan- <br />ned for construction near the town ef Aspen as part of the project but <br />also, unless the context requires othenvise, any other reservoir that may <br />be constructed in Vies tern Colorado above the town of Aspen in lieu of that <br />reservoir for the purpose of protecting water uses in Western Colorado. <br /> <br />"(f) "c.f.s." means cubic feet of water per second of time. <br /> <br />"2. The Aspen Reservoir shall be constructed and maintained on the Roar- <br />ing Fork River above the town of Aspen, Colorado, with an active capacity of <br />about 28,000 acre-feet and with a reasonable expectancy that it will fill annually. <br />The 28,000 acre-feet of water stored therein shall be available for replacement <br />purposes in Western Colorado.
