ATIACHMENT#l <br /> <br />DRAFT MEMORANDUM OF UNDERSTANDING <br /> <br />This memorandum of understanding ("MOU"), made this _ day of , 1998 <br />by and between the State of Colorado, for the use and benefit of the Department of <br />Natural Resources. Colorado Water Conservation Board ("CWCB"), and the Ruedi <br />Water and Power Authority (" Authority"). <br /> <br />WHEREAS. authority exists in the law, and funds have been budgeted. appropriated <br />and otherwise made available and a sufficient unencumbered balance thereof remains <br />available in Fund Number 424, Organization 5000, Appropriation A60. Grant Budget <br />Line RFFP. Program WfRC, Object Code 1920, Reporting Category ---, Contract <br />Encumbrance Number --; and <br /> <br />WHEREAS. required approval, clearance. and coordination have been accomplished <br />from and with appropriate agencies; and <br /> <br />. <br /> <br />WHEREAS, pursuant to Senate Bill 96-153. Section 7, the CWCB is authorized to expend <br />up to ---- in funds from the CWCB Construction Fund for the completion of a Multi- <br />Objective Study on the Roaring Fork River and the Frying Pan River ("Study"). <br /> <br />WHEREAS. the CWCB and the Authority have both acknowledged that it would be <br />beneficial to the thorough and timely completion of the Study, to the enhancement of its <br />relevance to the needs of the Roaring Fork and Frying Pan River valleys and their <br />residents, and to the increased likelihood of the implementation of any <br />recommendations within the Study to assure the active participation in and assistance <br />in the management of the Study by an entity that represents local interests in the <br />Roaring Fork and Frying Pan River valleys; and <br /> <br />WHEREAS, the Authority represents local governments in the Roaring Fork and Frying <br />Pan River valleys, including Garfield County, Eagle County, Pitkin County. the City of <br />Glenwood Springs, the Town of Carbondale. the Town of Basalt, the Town of <br />Snowmass Village, and the City of Aspen; and <br /> <br />WHEREAS, the Authority has stated its willingness to participate actively in the Study; <br />and <br /> <br />. <br /> <br />WHEREAS. the CWCB and the Authority have cooperatively developed, reviewed and <br />approved a Scope of Services for professional services to be provided by the Authority <br />for the Study. which Scope of Services is incorporated herein by reference; and <br />
