<br />- <br /> <br />e <br /> <br />e <br /> <br />Park Reservoir and the County's concerns regarding use of Colorado's compacted waters, <br />Robert Krassa, (Arapahoe County) asked that the CWCB consider assisting Arapahoe <br />County as a statewide issue, Dave Miller expressed concerns about the assignment of a <br />second filling on Taylor Park Reservoir by the Federal government Because it is an <br />unconditional decree, he believes Colorado may lose some of its compact apportioned <br />water, and suggested that structural means be reviewed to save Colorado's water. Barney <br />White commented on the CWCB's participation in the Upper Gunnison litigation for <br />many years and if there is a decision to take part in the case on a differently than in the <br />past, that other parties to the case be consulted, including the United States. He reiterated <br />that Judge Brown found that existing operations from the Aspinall Unit are consistent with <br />the Law of the River. Gary Sprung (High Country Citizen's Alliance) presented a rebuttal <br />to Arapahoe County, He reported that Taylor Park Reservoir was built for irrigators, and <br />Upper Gunnison Basin needs, and the water right and main flow from the reservoir <br />belongs to the Uncompahgre Water Users' Association. Jennifer Gimbel confirmed that <br />it would be appropriate for the Board to go into executive session on these items, A <br />motion was made by Lochhead and seconded by Eisel to go into executive session during <br />lunch. The motion passed by unanimous (9-0) decision. <br /> <br />Break for Lunch in Executive Session (12:30 - 2:21 p.m,) <br /> <br />Wednesdav Afternoon, January 20, 1993 <br /> <br />Call to Order (2:21 - 2:21 p.m.) <br /> <br />Chairman Martineau called the meeting back to order at 2:21 p,m" and there was a <br />quorum. Present were Salazar, Harrison, Jackson, Martineau, Lochhead, Sheftel, Wright, <br />Meyering, Simpson and Lile, Absent were Smith, Eisel, Norton and Olson. Jennifer <br />Gimbel sat at the table for Gale Norton. Eisel returned at 1 :24, <br /> <br />9. <br /> <br />Report on Matters in Executive Session (2:21 - 2:24 p.m.) <br /> <br />Jennifer Gimbel reported that Arapahoe County's proposal for the CWCB to join in the <br />case on the issues they presented, at this point, the Board is not making any decisions and <br />will monitor the case, and Steve Sims will inform the Board of new developments. Next <br />she reported on Kansas v. Colorado issues in the case were discussed by the Board, a <br />wrap-up of the case before the Special Master, as well as responses expected from Kansas <br />regarding these issues, The A WDI Case was discussed next, the AG is on a briefing <br />schedule with the Supreme Court, Colorado will be discussing most of the issues brought <br />up by A WDl, including the Closed Basin issue, The Board was informed that there have <br />been some discovery requests and issues regarding those requests on the Snowmass Creek <br />case and that the State has filed a motion for a protective order. The Animas La Plata <br />case was discussed and the Sierra Club's proposal to discuss the Project Alternatives. <br />Janice Sheftel left the meeting during the Animas La Plata discussion.
