Agenda Item 17a
January 8, 1993
Page two

e

Potential for Injul)'

The proposed on-stream reservoir would inundate approximately 2.5 miles of the
Board's instream flow appropriation on Geneva Creek as well as 1.5 miles on Bruno Gulch
and 1.0 mile on Burning Bear Creek. In addition, the proposed out-of-priority storage by
exchange with transmountain water delivered by the Roberts Tunnel may deplete the
Board's instream flow rights on Scott Gomer Creek and Geneva Creek.

Other Objectors

There are no other objectors in this case. However, at the time this memo was
prepared, the period for filing statements of opposition to this application had not yet
expired.

Staff Recommendation

The staff recommends that the Board ratify the statement of opposition filed in this e
case to protect the Board's instream flow rights on Geneva Creek, Bruno Gulch, Scott
Gomer Creek, and Burning Bear Creek.

DCM/JB
Attachment

1-92CW109.S0P

.
