<br />Jennifer Gimbel reported on two matters discussed in executive session. The Harvey vs. _.. <br />DNR case was settled. Steve Sims reported on the consultation with the Division WI' <br />Engineer regarding The Nature Conservancy case, and that the case has re-referred to the <br />Judge. Martineau left the meeting during discussion on the TNC case, <br /> <br />4d. Attorney General's Report (9:21 - 9-25 a.m.) <br /> <br />Gale Norton reported that the trial portion of the Kansas vs, Colorado case has concluded, <br />the written work is now being prepared for the Special Master, Colorado's portion on the <br />Nebraska vs. Wyoming case was presented by Gale to the Supreme Court in mid-January, <br />1993. The court has been asked to formally expand the scope of the case in order to <br />allocate the non-irrigation season flows, No action was taken. <br /> <br />N/A Wilderness Bill Issue' (9:25 - 9:27 a.m.) <br /> <br />The Board discussed the compromised form of this Bill that was to be introduced by <br />Senators Brown and Campbell. Jim Lochhead made a motion for the Board to support <br />the legislation as introduced by Senators Brown and Campbell, and direct the CWCB <br />Director to write a letter to the Senators expressing that sentiment of the Board. The <br />motion was seconded by Janice ShefteL The motion passed unanimously (8-0). <br /> <br />12d. Construction Fund - Recommended Projects' (9:27 - 9:59 a.m.) <br /> <br />Northern Water Conservation District - Karl Dreher of the Northern Water Conservancy e <br />District gave a presentation on the estimated costs associated with construction of the <br />Southern pipeline for the Southern Water Supply System, A preliminary design level of <br />the study has been completed, The communities of Ft Morgan, Ft Lupton, Wiggins, <br />Erie, Berthoud and Hudson have expressed interest in the project The costs were <br />allocated to these communities on a pro rata basis, Northern is the project sponsor, but <br />will not participate financially, as this project would only serve a small subset of their <br />constituents. Additionally, there is a request from the town of Superior to refinance an <br />existing loan of $400,000 through the CWCB at a lower interest rate. There was general <br />discussion by the Board members. David Harrison made a motion to tentatively accept <br />the Northern Pipeline Project at the level of $6,000,000 from discussion today. Final <br />action will depend upon individual loan applications from the individual participating <br />municipalities that need to be into us in ample time prior to our workshop on February <br />19, 1993. Bob Jackson seconded the motion, The motion passed unanimously (8-0). <br /> <br />Colorado River Decision Support System - David Harrison gave an overview of the <br />Feasibility Study Report for the Colorado River Decision Support System, including the <br />study milestones and a tabulation of the Project Cost and Schedule. A motion was made <br />by David Harrison to include as a non-reimbursable project, $1,420,400 for Decision <br />Support System in this year's Construction Fund package, with an amendment stating that <br />the one FTE in the CWCB ($100,000) and the two FTE's in the Department of Water <br />Resources ($150,000) are connected with the Decision Support System, Jim Lochhead _ <br />seconded the motion with the amendment Additional general discussion continued . <br />between Eisel, Harrison, Dick Stenzel (DWR), Lite, Simpson, Jackson, Bill Stanton, Steve <br /> <br />10 <br />
