5. The water to be made available to Mexioo shall be in such
amounts and at suoh times as may be requested by Mexioo,
provided that flows ordered by Mexioo in exoess of 4,000
second feet shall be subject to the deoision of the Seoretary
of the Interior, or whoever may be charged with the control
of power production at Boulder Dam and other dams below
that point on the Colorado River, as to the availability of
suoh exoess flow without adversely affeotin/!; the use of water
for power produotion in acoordanoe with oontraots for such
power, made under the Boulder Canyon Project Adjustment Aot.

6. Mexioo may use any water ,available in the river between the
upper and lower boundaries, but with no obligation on the
part of the United States to make available any of suoh water.

7. Mexioo must waive all rights and claims to the use of water
of the Colorado River system not provided for herein.

WE RECOMMENDI

1. That the United states oooperate with Mexioo in the making
of studies to determine the 81Il.ount and rate of flow of water
from surface and sub-surface sourGes whioh may be available
below the upper boundary for use in Mexioo.

2. That the United states oooperate with Mexico in studies
and in oQJlstruotion of improvements to the river ohannel
below the upper boundary.

3. That the United States provide flood oontrol on the Lower
Gila River for the protection of lands in the United States
and Mexico.

WE ASKI

1. That in negotiating the treaty the Department of State
reoognize that within the United states the Colorado River
Compaot and the Boulder Canyon Projeot Aot as BJIlended by
the Boulder Canyon Adjustment Aot are the law governing
the Colorado River and that it reoognize the allooations
and oontraots for water and power _de thereunder.

2. That the Department use in negotiating the treaty suoh
servioes and advioe of qualified experts upon the subjeot
as the interested States of the Basin may offer,

,. That the interested States be advised of the terms of any
proposed treaty and be permitted to oomment thereon, before
any fiI'lll oommitment has been made.
