The water to be made available to Mexioo shall be in such <br />amounts and at suoh times as may be requested by Mexioo, <br />provided that flows ordered by Mexioo in exoess of 4,000 <br />second feet shall be subject to the deoision of the Seoretary <br />of the Interior, or whoever may be charged with the control <br />of power production at Boulder Dam and other dams below <br />that point on the Colorado River, as to the availability of <br />suoh exoess flow without adversely affeotin/!; the use of water <br />for power produotion in acoordanoe with oontraots for such <br />power, made under the Boulder Canyon Project Adjustment Aot. <br /> <br />6. Mexioo may use any water ,available in the river between the <br />upper and lower boundaries, but with no obligation on the <br />part of the United States to make available any of suoh water. <br /> <br />7. Mexioo must waive all rights and claims to the use of water <br />of the Colorado River system not provided for herein. <br /> <br />WE RECOMMENDI <br /> <br />1. That the United states oooperate with Mexioo in the making <br />of studies to determine the 81Il.ount and rate of flow of water <br />from surface and sub-surface sourGes whioh may be available <br />below the upper boundary for use in Mexioo. <br /> <br />2. That the United states oooperate with Mexico in studies <br />and in oQJlstruotion of improvements to the river ohannel <br />below the upper boundary. <br /> <br />3. That the United States provide flood oontrol on the Lower <br />Gila River for the protection of lands in the United States <br />and Mexico. <br /> <br />WE ASKI <br /> <br />1. That in negotiating the treaty the Department of State <br />reoognize that within the United states the Colorado River <br />Compaot and the Boulder Canyon Projeot Aot as BJIlended by <br />the Boulder Canyon Adjustment Aot are the law governing <br />the Colorado River and that it reoognize the allooations <br />and oontraots for water and power _de thereunder. <br /> <br />2. That the Department use in negotiating the treaty suoh <br />servioes and advioe of qualified experts upon the subjeot <br />as the interested States of the Basin may offer, <br /> <br />,. That the interested States be advised of the terms of any <br />proposed treaty and be permitted to oomment thereon, before <br />any fiI'lll oommitment has been made. <br /> <br />We express our gratitude for the opportunities for infor- <br />mation and oons.ultation whioh have been afforded us by the Department <br />01' State and for the separate handling of the negotiations upon the <br />Colorado River and the Rio Grande, and will most respeotfully ap- . <br />preoiate the continuanoe of these polioies." <br />
