The State of Colorado is a signatory state in two <br />major interstate compacts relating to the Colorado River. The Colorado River Compact <br />allocates the water of the Colorado. River basin between the upper basin states <br />(Colorado, Wyoming, Utah, and New Mexico) and the lower basin states (Nevada, <br />Arizona, .and California). The Upper Colorado River Compact allocates the upper basin <br />states' entitlement among the upper basin states. The Upper Colorado River Compact <br />specifically requires a minimum delivery by .Colorado from the Yampa River of <br />5,000,000 acre-feet in any ten years as measured at the Maybell Gaging Station. On <br />an average annual basis, the Compact delivery requirement is 500,000 acre-feet <br />(5,000,000 ac-ft + 10 'f'ars). <br /> <br />The recreational use of the streamflow at the Boating Park is non-consumptive; <br />therefore, it does not consume any of the water available to Colorado under its compact <br />entitlement, As described above, the drainage basin upstream of the Boating Park is <br />594 square miles, or 17.4 per~ent of the 3,410 square mile Yampa River drainage basin <br />above the Maybell Gaging Station, The average annual flow at the Boating Park is <br />approximately 372,200 acre-feet, or 32.1 percent of the 1,159,200 acre-feet at the <br />Maybell Gaging Station. Therefore, the largest portion of the Yampa River drainage <br />basin and the largest portion of the available water production occur downstream from <br />the Boating Park water right. Approximately 97 miles of river and 2,816 square miles <br />. of drainage basin separate the Boating Park right and the Maybell Gaging. Station, <br />providing ample opportunity for future development of water resources within Colorado. <br /> <br />e <br /> <br />Upstream Water RiQhts. The average annual flow of the Yampa River diverted <br />pursuant to the Boating Park water right would be approximately 104,900 acre-feet. <br />
