The new Rule 5.00 .- <br />incorporates guidelines regarding the Board's declaration of its intent to appropriate, publication, _ <br />notice requirements, appropriation date and final Board action. Further, the proposed Rule <br />directs informal public notice and comment occurring before and after the Board declares its <br />intent to appropriate; appropriations mailing lists; and protests to Final Staff Recommendations. <br />The proposed Rule 5.00 clarifies Staff's abilities and obligations regarding Statements of <br />Opposition filed by the CWCB. The Rule explains the intent and the scope of new procedures <br />and creates the following new procedures: procedures, parameters and requirements for <br />contesting a proposed ISF recommendation, filing requirements, and interested persons' rights <br />and responsibilities as well as procedures for prehearing conferences and hearings on contested <br />Staff Recommendations, including requirements, notices and conduct. <br /> <br />The following described changes to Rule 10.00 were initially adopted in 1998, and will be <br />readopted in this rulemaking. The changes incorporate the statutory requirements of 937-92- <br />102(4). The changes to Rule 10.00 clarify the public review processes that apply to modifications <br />under the Recovery Implementation Program and where criteria for such modifications will be <br />established. Rule 10.00 also modifies requirements of written determinations of the Board and <br />expanded the public review process for modifications. <br /> <br />Modifications were made to Rule 12.00 to streamline and clarify certain notice <br />procedures. <br /> <br />EFFECTIVE DATE <br /> <br />e <br /> <br />The additions and changes contained in Rule 5.00 and 12.00 herein will become effective <br />on December 31, 1999. Those additions and changes to Rule 10.00 incorporating statutory <br />requirements are effective to the extent the law already requires them. To the extent the rules add <br />to those statutory requirements the rules are effective 20 days after publication of the final rules in <br />the Colorado Register. <br /> <br />SPECTFTC STATUTORY A UTRORTTY <br /> <br />The statutory authority for the additions and amendments to the ISF Rules is found at <br />937-60-108 C.R.S. (1999) and 9 37-92-102 CRS. (1999).
