<br />FROM THE FLOOR: <br /> <br />Who is that? <br /> <br />MR. SPARKS: <br /> <br />Your Conservancy District is the <br />San Luis Valley Conservancy District and <br />the Conejos Conservancy District are the <br />two agencies which are vested with the <br />responsibility for determining matters <br />pertaining to water down here. I assume <br />their decision would be the one that <br />governs as long as it was based upon actual <br />evidence. It is no difficult job. This <br />is a simple thing, it is simple to determine <br />whether or not the water table is coming <br />down. <br /> <br />I <br /> <br />This project would have a series of <br />observation wells connected with it so <br />it is a simple matter to determine your <br />water table. But, certainly, I think this <br />Conservancy District would be the governing <br />body as it is throughout the state in <br />connection with these federal projects <br />or you would have no water. <br /> <br />GOVERNOR MCNICHOLS: Have you researched about the contribution <br />of ground water? <br /> <br />MR. SP ARKS : <br /> <br />I don't think it has any bearing on <br />the project. We would see that it was <br />taken care of in the legislation, that there <br />would be provisions that this did not create, <br />this pumping of water, did not create any <br />obligation against the State of Colorado. <br />It would take care of that either in the <br />legislation or in the documents which -- <br />the Senate or House documents which accompany <br />that. We were worried, of course, about <br />setting some precedent, as Mr. Coleman <br />stated, but that since this would be a <br />federal project, the mechanics of that <br />would be taken care of in the federal <br />legislation and that was something we fore- <br />saw at the beginning that that was something <br />that would have to be taken care of. We <br />did not want any obligation created against <br />the State of Colorado which would force us <br />to pump water into the river in the event <br /> <br />I <br />
