<br />Statewide Issues <br /> <br />Informal Rulemaking Initiated for Recreationlll In-Channel Diversion Rules: We have mailed the <br />draft rules to our Agenda mailing list. We have sche~uled public meetings across the state to collect <br />comments. on these rules, The schedule of these meetings and the proposed rules can also be found on e <br />our Web site: www.cwcb.state.co.us. <br /> <br />Staff Revises Instream Flow Quantification Policy Memo: Based on comments received at the <br />Board's May 2001 meeting, staff has revised its proposed Instream Flow Quantification Policy memo <br />(see attachment). Staffhas received comments from the Colorado Division of Wildlife, Bureau of Land <br />Management, and Trout Unlimited. In addition, the United States Forest Service has indicated that they <br />would like to provide comments, Staffis in the process of reviewing these comments, After completing <br />its review, staff will present its evaluation ofthe cominents to the Board along with any further revisions <br />to the policy for the Board's consideration. ' <br /> <br />Agricultural and Rural Law Roundup: On June 23, Ted Kowalski of the Stream and Lake Protection <br />Section presented a paper, with Cindy Covell of Alperstein and Covell, entitled: Recreational In- <br />Channel Diversions, Water Use or Abuse? The paper was well received and, as always, the topic <br />generated a lively discussion. <br /> <br />Water Legislation Review Committee Meeting: The new Water Legislation Review Committee has <br />scheduled meetings on Aug. 9 from 10:00 a.m. to 5:00 p.m, and Sept. 6 from 10:00 a.m. to 5:00 p.m. <br />Members of the Committee will include Rep, Diane lfoppe (Chair), Sen. Jim Isgar (Vice-Chair), Rep. <br />Mary Hodge, Sen. Lewis Entz, Rep. Gregg Rippy, S'en. Deanna Hanna, Rep. Abel Tapia, Sen, Terry <br />Phillips, Rep. Brad Young and Sen, Jack Taylor. At 'its first meeting the committee is expected to <br />review a host of state and federal issues, however, no agenda has yet been published, <br /> <br />Natural Lakes Database: The Stream & Lake Protection Section has recently completed development <br />of a new database for our Natural Lake Level (NLL) water rights. This database includes the name, A <br />location and decree information for each lake water tight that the Board holds, (Information about the .- <br />Board's Instream Flow Appropriations and Donated,i Acquired Water Rights is already included in a <br /> <br /> <br />exercising water rights in accordance with state and federal laws, Bypass flow claims contravene one of <br />the primary purposes for which forest land were reserved--to secure favorable water flows for water <br />providers. Moreover, bypass flows simply don't work. They fail to provide environmental protection arA <br />instead create an atmosphere of hostility, litigation and distrust. .- <br /> <br />Clean Water Act/NPDES Permits/Herbicides: The EP A will not enforce the Headwaters, Inc. v, <br />Talent Irrigation District decision by the U.S, Ninth Circuit Court of Appeals, The decision raised fears <br />that farmers and ranchers applying herbicides and pesticides in accordance with label instructions might <br />be subjected to sanctions for failing to obtain an NPDES permit. However, the EP A is expected to <br />advise states that water users and others applying chemicals may still be subject to third party lawsuits, <br /> <br />New Arizona Water Official: Joseph Smith has been 'appointed to be the Director of the Arizona <br />Department of Water Resources, Smith replaces Rita Pearson Maguire. Smith has been the Deputy <br />Director since 1994. <br /> <br />GAO Hydropower Report: The Govemment Accounting Office has released a new hydropower <br />licensing report. The report assesses the FERC licensing process, It examines why the licensing process <br />now takes longer and costs more and whether there is a need for licensing process reforms, The GAO <br />'found that since 1986 FERC has been required to give' "equal consideration" to other competing resource <br />needs. Additional environmental and land management laws have also added new requirements to the <br />licensing process. The report can be review on the Wep at www.lIao.lIov.
