PCSR <br />gambles that sufficient rain will fall, in the long run, to repay both the deficit created by the initial and <br />supplemental pumping, thereby restoring the stream system to its nonnal condition," <br /> <br />Congratulations to the Stream and Lake Protection section and to the Office of the Attorney General on <br />this ruling, <br /> <br />Golden Lawsuit: On June 13 Judge Hays granted a decree for Golden's recreational in-channel <br />diversions, Though Golden did not receive absolute rights for nighttime uses, or in the full amount they <br />requested, the water court did grant them their entire request on a conditional basis and made the actual <br />proved usage absolute, The court held that the structures were not fully overtopped, and even those <br />parts of the structures that were overtopped still exerted control. The court also held that the amounts <br />requested were reasonable given Golden's intention to have a world class kayak course. The State <br />Engineer is considering filing an appeal to the Colorado Supreme Court, and the CWCB wiII consider <br />filing an appeal at the July 2001 Board meeting, <br /> <br />Staff Makes Presentation to Ft. Collins Sertoma Club: On Jnne 8, the Stream & Lake Protection staff <br />gave a powerpoint presentation about the Water Acquisition Program to the Fort Collins Sertoma Club, <br />The presentation, hosted by fonner CWCB member Bill Brown, was attended by over 50 people, The <br />presentation covered program history, status, recent donations and the value of the program for <br />achieving streamflow protection goals. <br /> <br />Cherry Cree); PMP Study: The National Weather Service required us to folIow fonnal procedures for <br />a Freedom ofJnfonnation Act request for reports, computations and models used in the original Corps <br />1995 PMP report, The infonnation will be useful as the study team draws comparisons from their own <br />findings throujlh stonn reconstruction and analysis of peak precipitation, The next meeting of the Cherry <br />Creek PMP Study team is August 9. This project is gaining national attention and may encourage the <br />Corps and NWS to incorporate the Cherry Creek PMP study techniques and findings into future PMP <br />Studies. The focus in the this project will eventually require more active participation from the Corps to <br />utilize technical review findings and make decisions regarding dam safety for the Cherry Creek <br />Reservoir. <br /> <br />Chatfield Reservoir Reallocation Study: Simons and Associates have been contracted to aide in the <br />design of a hydraulic river model for the South Platte River from Chatfield Reservoir to the Nebraska <br />state line to aide in this study, Additional surveys and mapping were needed to fill in the gaps that exist <br />within the Denver Metro Area. Earth Surface Systems has also been contracted to do a water rights and <br />water availability investigation on Chatfield Reservoir to help the Corps and the CWCB get a better feel <br />of the water rights picture. Three work groups have been fonned to represent water supply, technical <br />review and recreation interests of Chatfield Reservoir Study and to aide in the review of study findings. <br />The next meeting is scheduled for August 29. <br /> <br />Dry Creek Flood Control Project: A $50,000 grant to Larimer County from the construction fund was <br />approved by the Board at the January 2001 meeting for a feasibility study related to the multi-million <br />dollar flood control project on Dry Creek. The proposed project would remove a substantial amount of <br />homes and property from the regulatory 100-year floodplain. The CWCB Flood Protection Program <br />staff has been working closely with the Water Supply Planning and Finance Section staff, along with the <br />local project sponsors, to select a consulting finn to complete the engineering and financial feasibility <br />study for the project. ECI was recently selected to begin work on completing the feasibility study, ECl's <br />schedule calls for a final report to be submitted to the CWCB by August 30,2001. A major loan <br />application will be submitted by Larimer County to the CWCB for potential approval at the November <br />2001Board meeting, <br /> <br />11 <br />
