<br />2 <br /> <br />use~s ~ho C3n put said ~ater to bene:ici~l USe and, there:ore, Recla~ation ~ <br />and CQ~Y intend to identify which of the gl~ci21 ~or2ine sites subject to <br />~atec eight applications n~~ed oc contcolled by CORY potentially might <br />satisfy such needs; and <br /> <br />~REAS, Under acts of Harch 4, 1921 and December 5, 1924, <br />Reclaoation is authorized to receive, accept and expend in connection with <br />money appropriated by the United States for the pUrposes for ~hich contri- <br />buted as though specifically appropriated therefore, moneys for, among <br />other things, cooperative investigations and surveys involving operations <br />si~lar to those provided for in Reclamation Law; and <br /> <br />WHEREAS, it has been determined chat a joint, cooperative study <br />and investigation and cost sharing program between Reclamation and CORY is <br />necessary to dete~ne which of the 71 designated projects are best suited <br />to potentially serve as water storage sites; and <br /> <br />WHEREAS, subject to congressional authorization and appropriation, <br />Reclamation and CORY intend to pursue further investigation and development <br />of such sites through modifications or amendments to this contract if the <br />cooperative studies here described show that uSe of any or all of these <br />glacial moraine sites may be potentially feasible of development from an <br />economic and engineering view; and <br /> <br />WHEREAS, Reclamation acting through the Regional Director, Lower <br />Missouri Rhegion, Denver, COlordado, and Upper Cfolorahdo DRegion, Salt La~e .~ <br />City, Uta, have been delegate the lead role or t ~ epartment of the <br />Interior for the purpose of implementing these studies as well as the <br />exercising of any other rights pursuant to this agreement; and <br /> <br />WHEREAS, the Lower Missouri Region will take the lead on all' <br />studies east of the Continental Divide and those west of the divide that <br />are tributary to the collection systems of the Colorado-Big Thocpson and <br />Fryingpan-Arkansas and tributary to Green Mountain and Ruedi Reservoirs, <br />and the Upper Colorado Region will take the lead on all other studies west <br />of the Continental Divide. <br /> <br />New, THEREFORE, in consideration of these premises and the mutual <br />agreements herein contained, the parties to this contract covenant and <br />agree as follows: <br /> <br />1. SPECIAL INVESTIGATIONS <br /> <br />1.1 The parties agree that CORY shall provide 50 percent of the <br />total cost required for the investigations as enumerated in exhibit A attached <br />hereto and made a part hereof. <br /> <br />1.2 Commencing with the execution of this contract by the parties <br />hereto and d~ring the fiscal yeac 1986 beginning October 1, 1985, Reclamation <br />will initiate wock and will perform and advance as rapidly as practicable ~ <br />those items outlined in the Plan of Study.
