<br />/ <br /> <br />. <br /> <br />. <br /> <br />UNITW .STAT~S <br />DEPARTXENT OF WE I:;TERIOR <br />BUREAU OF RE.CLAXA.TlON <br /> <br />CO~iTRACT BET1.'EEN nrc: UNITED STATES A!;]) Tr{E CORY COMP.oBY, INCOP.POP~HED FOR <br />JOIST COOPERATIVE SPECIAL INVESTlGATlOSS OF POTENTL\L TER.'!INAL GLACIAL <br />HQRAI~-;: STOP_A.GE SITES <br /> <br />THIS CONTRACT, Made this ~ day of August, 1984, bet~een <br />the UNITED STATES OF AMERICA, acting through the Bureau of Reclamation, <br />Depart~nt of the Interior, represented by the contracting officer <br />executing this contract (hereinafter called Reclamation) pursuant to <br />the Act of June 17, 1902 (32 Stat. 388) and acts acendatory and supple- <br />mentary thereto including, but not limited to, the Act of March 4, 1921 <br />(41 Stat. 1404); the Act of December 5, 1924 (43 Stat. 685, 704); the <br />Act of August 4, 1939 (53 Stat. 1187); the AcE.. of June 13, 1962 (76 <br />Stat. 102); the act of August 16, 1962 (76 Stat. 393); and the Act of <br />June 24, 1974 (88 Stat. 270); and CORY COMPANY, INCORPORATED, a cor- <br />poration organized and existing pursuant to the la~s of the State of <br />Colorado (hereinafter called CORY). <br /> <br />WITNESSETH: <br /> <br />WHEREAS, Reclamation has responsibilities of studying and pro- <br />viding ~ater storage facilities for the purpose of supplying ~ater.for <br />irrigation, municipal and industrial users and other entities throughout <br />the State of Colorado; and <br /> <br />WHEREAS, CORY and its associated companies own or control ~ater <br />right applications ~hich have been filed in Colorado ~ater courts as to <br />71 terminal glacial moraines and are engaged in the business of studying, <br />developing; financing, and building ~ater projects and intend to utili~e . <br />terminal glacial moraines as a method of providing ~ater storage facilities <br />for the purpose of supplying ~ater for municipal and .industrial and irriga- <br />tion uses and other entities throughout the State of Colorado; and <br /> <br />WHEREAS, Reclamation has a continuing responsibility to study <br />the safety of its existing facilities and the quality of ~ater in the Colorado <br />River System including studying and evaluating the potential of reducing direct <br />depletions and transmountain diversions from the System and improving and main- <br />taining minimum streamflows and therefore desires to study the potential of <br />improving the yield and operations of'existing Reclamation storage and distribu- <br />tion facilities through the integration of glacial moraine storage; and <br /> <br />WHEREAS, Reclamation may be able to recapture Federal investment of <br />Federal ~ater projects SOoner by marketing ~ater froc these glacial moraines in <br />conjunction ~ith existing Federal reservoirs; and <br /> <br />~HEREAS, a large majority of said glacial moraines are located on <br />lands of the United States of America; and <br /> <br />\.IHEREAS, Reclam.:lt ion, pu rsuant to its au thori ty under Reclalll3tion <br />~ Law can identify and substantiate existing needs for water by various ~ater <br />
