Review and Approve Amendments and Revised Proposals Concerning The CWC <br />State Affairs Study/W ater Bank Pilot Project Bill <br />Action: A motion was made by Harold Miskel that the Board support <br />incorporating the Colorado Water Congress version of a study bill into the <br />existing SB 161 legislation. The motion was seconded by Eric Wilkinson <br />and approved unanimously (9-0). <br /> <br />2c. Review and Approve Amendments and Revised Proposals Concerning The <br />Recreation Flow Bill <br /> <br />Action: <br /> <br />Adjourn 11 a.m. <br /> <br />A motion was made by Harold Miskel to support the bill as drafted except <br />for the following changes: <br />1) Add language to insure the Board has the right to file a Statement of <br />Opposition and participate in the litigation; <br />2) Reword Paragraph V page 3 and 4 dealing with maximum utilization <br />of the state's water resources to refer to the statute, 37-92-1 02(1)(a), <br />that declares that it is the policy of the state of Colorado to maximize <br />the beneficial use of all the waters of the state; <br />3) Delete VI at top of Page 4, lines 2-4; and <br />4) Reword subsection 14, page 6, line 18 to reflect that applications for <br />recreational in-channel diversions for which no decree has been <br />entered as of the effective date of this legislation, but for which the <br />judicial record is complete and closed, shall be grandfathered, e.g., <br />exempted from the requirements of this legislation.. <br />The motion was seconded by Eric Wilkinson and approved unanimously <br />(7-0).
