<br />A motion was made by Janice Sheftel that relevant cross-examination would <br />be allowed, but that subpoena of people who wrote dated documents relating <br />to the issues on this case would not be made without a reasonable cause. The <br />motion was seconded by Patricia Wells and approved unanimously (8-0). <br /> <br />A motion was made by Patricia Wells that preliminary disclosures would be <br />made by May 31,1996, and final disclosures would be made 30 days before <br />the hearing, which would be June 9th. Briefs of positions would be <br />submitted by formal parties 10 days prior to the hearing. Anything that <br />would be required to be mailed would be mailed directly to Board members, <br />in addition to the other formal parties. The motion was seconded by David <br />Smith and approved unanimously (8-0). <br /> <br />A motion was made by Patricia Wells that if a dispute comes up regarding <br />deadlines or dates there could be special meetings by telephone before July <br />9th, but that this would be done only if it was unavoidable. The motion was <br />seconded by Eric Kuhn and approved unanimously (8-0). <br /> <br />At this time, the discussion turned to the actual agenda item issues. David <br />Harrison recused himself. <br /> <br />A motion was made by Patricia Wells that adequate grounds for modification <br />by the staff exist in this case. The motion was seconded by David Smith and <br />approved unanimously (7-0). <br /> <br />11. Instream Flow Program - Reserved Rights Decrees for Mesa Verde and Hovenweep <br />Tape 2, Start/Stop: 3876 - 3880 <br />Action: This item was presented during Executive Session. <br /> <br />12a. Arkansas River Basin Issues - ComputerfTechnology Grants to Water User Groups <br />Tape 2, Start/Stop: 3880 - 4365 <br />Action: A motion was made by Janice Sheftel to accept the staff recommendation that the <br />Board review and approve the conceptual draft MOU, and provide any <br />needed guidance in the preparation of a final MOU that the directors will <br />sign when it meets their approval. The motion was seconded by Eric Kuhn <br />and approved unanimously (7-0). <br /> <br />12b. Lower Arkansas Water Management Association (LAWMA) - Request for <br />Substitution of Collateral on Construction Fund Loan Contract <br />Tape 2, Start/Stop: 4365 - 5850 <br />Action: A motion was made by Ray Werner to accept the staff recommendation to approve <br />the partial release of the deed of trust for the land, including all options listed <br />in both the Board memo, and to empower the Director to resolve problems <br />with the help of the staff, and for the Director and staff to consummate this <br /> <br />Minutes May 13-14, 1996 CWCB Meeting <br />
