<br />8. Instream Flow Program - Statements of Opposition <br />Tape 2,Start/Stop: 0001 - 0250 <br />Action: Items a-e were taken together. A motion was made by Patricia Wells to accept the <br />staff recommendations to ratify the statements of opposition which have been <br />filed by the staff to protect instream flow water rights on the streams listed. <br />The motion was seconded by Janice Sheftel and approved unanimously (8-0). <br /> <br />9a. Instream Flow Program - Authorization to Proceed to Trial Case No. 1-94CW268; <br />Lakeview Village <br />Tape 2, Start/Stop: 0250 - 0314 <br />Action: Information item; no action taken. <br /> <br />10. Instream Flow Program - Preliminary Review of Request for Modification - Snowmass <br />Creek <br />Tape 2, Start/Stop: 0314 - 3860 <br />Action: David Harrison recused himself from voting on this issue, but said that he would <br />participate in the setting of meeting dates and establishing a procedure to be <br />followed. During the discussion on procedure setting, there were seven <br />motions made. <br /> <br />A motion was made by Ray Werner that the procedures will be set frrst, and <br />then the hearing date would be set for a day and a half sometime convenient <br />to the Board in late July or August. The motion was seconded by David <br />Smith and approved unanimously (8-0). <br /> <br />A motion was made by Ray Werner that the beginning of the meeting be set <br />for the afternoon of July 9th, preferably at 2:00 p.m., and that it would <br />continue through July 10th in the GlenwoodlSnowmass area. The motion <br />was seconded by Eric Kuhn and approved unanimously (8-0). <br /> <br />A motion was made by Patricia Wells that the order of presentation would be <br />staff presentation, supporters' presentation, and opponents' cross-examination <br />on the frrst day, and then opponents' presentation and cross examination by <br />supporters. Tills would be followed by a summing up/response by supporters <br />and opponents, public comments heard, and then a summary by the staff. <br />The motion was amended to reflect that the cross-examining would occur <br />within the supporters and opponents. The amended motion was seconded by <br />Eric Kuhn and approved unanimously (8-0). <br /> <br />A motion was made by Janice Sheftel that the role of the CWCB staff would <br />be defined that they could ask questions of people, and could clarify issues in <br />an effort to inform the Board, but without taking a position either as <br />supporters or opponents.
