FETCHER: Right. <br /> <br />MR. STAPLETON: Knowing it needs a resolution to that effect, if there <br />is anyone that should be d~opped out, you will let us know after lunch. <br /> <br />MR. FETCHER: Fin~. <br /> <br />MR. ROBBINS: Mr. Chairman, may I make a couple of comments generally? <br /> <br />MR. STAPLETON: Yes. <br /> <br />MR. ROBBINS.: I just wanted to inform the board that I have not yet <br />made application, based upon your January approval. The reason for <br />this is that I submitted a new application for Justice Groves of the <br />Colorado Supreme Court. I reque~ted that he coordinate with the seven <br />water judges th~ contents of that application. Duane and Eddie. and I <br />have had some problems in getting :the various Water Courts to agree <br />upon what is acce~table for a minimum streamflow application, and the <br />various division engineers, I might add. <br /> <br />Many of our. lakes and streams are in.u~s~rveyed areas, and it is very <br />difficult for us to come up with accurate section ~oncepts of range <br />descriptions. We have tried in some divisions to use longitude and <br />latitude. In some divisions, that has not been acceptable. <br /> <br />We are using surface appropriation forms and reservoir forms. The <br />information requjred thereon doesn't correspond to what is necessary to <br />make a minimum stream flow or lake level app~ication. So I have chosen <br />to stack all of these up and wait until Justice Groves gives me the go- <br />ahead on using this new form, which should take_ care of all of the <br />problems that the various referees and division engineers and water <br />judges have had with us. <br /> <br />If he does not give me approval in the next month, I propose to go <br />ahead and use the old forms again. As long as we file the application <br />by December of this year, we will get the same appropriation date, and <br />it won't affect our legal standing. But I wanted to let you know that <br />many of the streams that you have approved, and lakes, have not been <br />filed on for that reason. <br /> <br />Generally, we have had very good cooperation from t~e Water Courts. We <br />have had a little bit of problem in Division 7. Other than that, all <br />of the rest of the water pfficials have been most cooperative in <br />attempting to move our program of minimum stream flows forward. <br /> <br />-25- <br />
