<br />- 2- <br /> <br />During negotiation of the Interagency Agreement, it became evident that an interagency . <br />agreement might not be the best mechanism by which to document the funding arrangement. <br />The CWCB staff proposed using a joint resolution that would be adopted by the CWCB and the <br />Colorado Wildlife Commission, As of the date of this memo, staff was waiting for confirmation <br />from the CDOW of whether it is willing to take this approach. If so, CD OW and CWCB staff <br />will draft the resolution and submit it to the FWS for review prior to bringing it to the CWCB <br />and the Wildlife Commission for adoption, If the FWS determines that the joint resolution does <br />not adequately address the issues raised in the audit, the parties may have to revisit using an <br />interagency agreement. <br /> <br />Proposed Joint Resolution <br /> <br />Briefly, the joint resolution would (1) set forth the background leading to the need for adoption <br />of the joint resolution; (2) describe the funding arrangement; (3) provide that the specific wildlife <br />purpose being achieved is the exercise of the CWCB's exclusive authority to appropriate <br />instream flow water rights in accordance with section 37-92-102(3), C.R.S, and the <br />implementation of the ISF Program; and (4) identify the documentation supporting this <br />arrangement (includes CWCB meeting agendas, minutes and memos, and the CWCB budget <br />schedule for the ISF Program submitted each fall upon which the annual appropriation of funds <br />is made. The CWCB and CDOW staffs will collaborate on drafting the joint resolution and <br />providing it to the FWS, <br /> <br />Conclusion <br /> <br />. <br /> <br />Staff anticipates bringing the proposed joint resolution to the Board at its May 2006 meeting for <br />adoption. <br /> <br />. <br /> <br />Flood Protection.
