<br />, <br /> <br />. <br /> <br />-, <br /> <br />e <br /> <br />e <br /> <br />e <br /> <br /> <br /> <br />MEMORANDUM OF UNDERSTANDING <br /> <br />This Memorandum of understanding ("MOU") is' entE!red into, this <br />~ ',' <br />oS day ofJ)~~\.:V"19<11, between the Colorado Water conserVation <br /> <br />Board ("Board") and the Colorado, Water Resources and Power <br /> <br />Development Authority ("Authority"). <br /> <br />1. The purpose of the MOtT is to aid and expedite the <br /> <br /> <br />performance of the sta~utory duties of the Board and the Authori.ty, <br /> <br /> <br />as 'set forth in' Articles 60 and' 95 of' Title' 37, C.R.S., <br /> <br />respectively. This MOU supercedes the MOU dated March 22, 1990, <br /> <br />between these parties. <br /> <br />. 2. This MOU shall govern the activities of the Board and the <br />Authority according to'its terms, unless either or both entities <br /> <br />are. otherwise directed ,by the Colorado General Assembly, by bill or <br /> <br />act, or by,joint resolution signed by the Governor. <br /> <br />3,. This MOU, shall not pertain, to the activities of the <br />Authority with respect to: (i) small water, resources projects, as <br /> <br />defined in Title 37, Article 95' C.R.S., except as provided in <br /> <br /> <br />paragraph 8 below, (i,i) projects funded by the Authority that <br /> <br /> <br />concern domestic water treatment and distribution systems, (iii) , <br /> <br />projects funded by the Authority's water pollution control <br />revolving fund, and (iv) any project that the Authority has been <br />authorized to consider by joint resolution of the General Assembly, <br /> <br />except a~ provided in pa~agraph 8 below. <br />
