<br />e <br /> <br />such as setting prehearing conferences and adjusting deadlines and <br />schednles to further the Parties' s~ttlement efforts or for other good calise <br />shown, All prehearing conferences'will be scheduled and held aefare prior <br />to the July Board meeting. <br /> <br />(2) On or before five working days before the prehearing conference, each Party <br />shall file 25 copies of itsa prehearing statement with the Board, and provide <br />an electronic version wherever pQssible, A- The prehearing statement shall <br />identify all exhibits, engineering data, biological data and reports or other <br />information that the Party will rely upon at the hearing and shall contain: <br /> <br />(a) A specific statement of the factual and legal claims asserted (issues to <br />be resolved) and the legal basis upon which the Party will rely; <br /> <br />(b) Copies of all eXhibits to be ,introduced at the hearing; <br /> <br />(c) A list of witnesses to be c~led and a brief description oftheir <br />testimony; <br /> <br />(d) Any alternative proposal to' the proposed iastrellfll flowIS.F <br />appropriation; <br /> <br />e <br /> <br />(e) All written testimony to be-offered into evidence at the hearing; and <br /> <br />(f) Any legal memoranda. <br /> <br />Each party shall deliver a copy o~ its prehearing statement to all other Parties, <br />Contested Hearing Participants, 1:1).e Hearing Officer and directly to the <br />Assistant Attorneys General representing Staff and the Board five working <br />days before the prehearing conference, The Board will not consider <br />information, other than rebuttal statements, submitted by the Parties after this <br />deadline except for good cause shown. <br /> <br />(3) Any Contested Hearing ParticiPll4t may also submit written comments 5 <br />working days prior to the preheating conference; Contested Hearing <br />Participants who submit written <iomments for the Board's consideration <br />shall provide a eap)' 25 copies to the Board, and a copy to all other <br />Contested Hearing Participants, ~arties, the Hearing Officer and the Assistant <br />Attorneys General representing *aff and Board, and provide an electronic <br />version wherever possible, ' <br /> <br />e <br /> <br />12 <br />
