Gentlemen:

As you are aware, HJR 1001, First Extraordinary Session of
the Fifty-Sixth General Assembly, directs that a study of the
state's water laws and pOlicies be undertaken by January 15,
1989, to the extent determined necessary. At a previously
scheduled special meeting held on Friday, August 26, the Board
took pUblic comment on, and deliberated about, the issue(s) to
be selected for study. .

Representatives Dan Williams and Dave Owen were present for
these deliberations. The purpose of this letter is to forward
to you the Board's recommendation for the study. The Board
will await your concurrence in its recommendation, or your
directions to the contrary, before it proceeds further.

Since HJR 1001 directs that the subject study be
accomplished without any additional staff or appropriations,
the Board has reviewed its existing workload. With all staff
fully committed, this study can only be undertaken by delaying
some activity scheduled for the next five months. Furthermore,
the preparation of a pOlicy study such as this will necessarily
fall on the Board's senior management personnel, especially the
director and deputy director.

The workload of these senior management people for the next
five months consists of many important items:

(1) On-going efforts to obtain enactment of legislation to
implement the Colorado Ute Indian Water Rights Final
Settlement Agreement and the Animas-La Plata Project
and of legislation to increase the authorized ceiling
for the Closed Basin Project,
