<br />. <br /> <br />aYYi~illd/0y/t~e/m0~ile/~ome//t0/itt/permallellt/tite/0r <br />t~e/date/0f/t0mpleti011/0f/t~e/m0~ile/~0me/parK( <br />w~it~e~er it earlier! <br /> <br />Structure - A generally walled and roofed building that is <br />primarily above ground and affixed to a permanent site, <br />including earth sheltered structures, o~en pavilions, <br />~0~ile manufactured homes, gas and liquid storage tanks, <br />agricultural storage tanks for chemicals such as pesticides <br />or fertilizers, septic tanks, and sewage treatment <br />facilities. <br /> <br />Substantial improvements - Any repair, reconstruction, or <br />improvement of a structure, the cost of which equals. or <br />exceeds 50 percent of the market value of .the structure <br />either (a) before the improvement or repair is started or, <br />(b) if the structure has been damaged and is being restored, <br />before the damage occurred. The term does not, however, <br />include either (1) any project for improvement of a <br />structure to comply with existing state or local health, <br />sanitary, or safety code specifications which are solely <br />necessary to assure safe living conditions or (2) any <br />alteration of a structure listed on the National Register of <br />Historic Places or on the Colorado State Historical <br />Society's list of historic places. <br /> <br />Use - Any man-made or man-caused activity, building, or <br />structure on a parcel of land, whether temporary or <br />permanent. <br /> <br />. <br /> <br />Variance - means a grant of relief from the requirements of <br />this ordinance which permits construction in a manner that <br />would otherwise be prohibited by this ordinance. <br /> <br />Watercourse - A natural or artificial channel, depression, <br />dry wash, slough, gulch, arroyo, stream, creed, drainagway, <br />pond, reservoir, or lake in which water flows either <br />continuously, intermittently, or periodically. <br /> <br />1.5 Exemptions - Nonconforminq Structures or Uses - The <br />provisions of these regulations shall not apply to a <br />nonconforming structure or use existing on the date the area <br />in which the nonconforming structure or use is located <br />becomes subject to regulation. When such nonconforming use <br />is discontinued for six months or more, or when such <br />nonconforming structure is damaged or destroyed by fl~od, <br />fire, wind, or any other means to the extent of at least 50 <br />percent of the"market value, as determined by the Permit <br />Authority, any reuse, reconstruction, or replacement of such <br />structure or use shall be deemed a new use and shall be <br />subject to the provisions of these regulations, including . <br />the requirement to apply for and obtain a Floodplain <br />Development Permit. Nonconforming structures or uses shall <br />not be expanded upon or, if removed, shall not be <br /> <br />-8- <br />
