<br />. <br /> <br />1.2 Findinqs of Fact - The (Board of County <br />Commissioners, City Council, Town Board of ) <br />finds that there are within ( County, <br />Municipality) floodplains which constitute natural hazards <br />of state and local interest, that flooding may cause <br />serious damage to properties and subject.residents of such <br />areas to hazards, that the occupation of such areas may <br />cause the loss of human life and the destruction of <br />property, and that the imprudent use and occupation of <br />these areas will pose as continuing and greater future <br />danger to life and property unless appropriate regulations <br />are adopted concerning the use and occupation of such <br />hazards. <br /> <br />1.3 Statement of Purpose - The purpose of this regulation is <br />to promote the public health, safety, and general welfare, <br />and minimize flood hazards and losses by provisions <br />designed to: <br /> <br />1.3.1 Promote sound planning and land use, and permit <br />only such uses within floodplains that will not <br />endanger life, health, and public safety or <br />property in times of flooding. <br /> <br />1.3.2 Protect the public from avoidable financial <br />expenditures for flood control projects, flood . <br />relief measures, and the repair and restoration of <br />damaged public facilities. <br /> <br />1.3.3 Prevent avoidable interruption of business and <br />commerce; <br /> <br />1.3.4 Minimize victimization of unwary home and land <br />purchasers; and <br /> <br />1.3.5 Facilitate the administration of flood hazard areas <br />by establishing requirements that must be met <br />before use or development is permitted. <br /> <br />1.3.6 Insure that those who occupy flood hazard areas <br />assume responsibility for their actions. <br /> <br />1.4 Definitions - Unless specifically defined' to be used <br />differently below, words and phrases in this floodplain <br />regulation are interpreted to give them the meanings they <br />have in ordinary usage. <br /> <br />Accessorv Use or Structure - A use of or structure on a <br />site that is directly related to but secondary to the <br />principal use(s) of or structure(s) on the site. <br /> <br />Administrator - The local administrative official <br />responsible for administering and implementing these <br />regulations as set forth in Section 4.1.1. <br /> <br />. <br /> <br />-2- <br />
