<br />0.69 cfs to 0.31 cfs. Consumptive water use will drop an average of 0.46 cfs to <br />0.13 cfs. The monthly depletions attributed to all users in the upper reach prior to <br />and following implementation of the Injury with Mitigation Plan are shown in <br />Figure 3, attached. <br /> <br />5. The BWCD will retain the services of a seasonal Hydrologic Technician to help <br />administer the provisions of the proposed Mitigation Plan. This position will be <br />responsible for field inspection of individual water users to confirm compliance <br />with the curtailment of outdoor use. <br /> <br />In summary, should the CWCB accept the proposed Injury with Mitigation Plan <br />associated with Case No. 01 CW305, the BWCD will pay 25% of costs to construct a <br />stream gage in the upper reach and contribute $5,500 annually for a minimum of five <br />years for on-going O&M requirements. Furthermore, should flows in the Roaring Fork <br />River above its confluence with the Fryingpan River approach CWCB minimum <br />streamflows during the April through September period, the BWCD will implement water <br />conservation measures including curtailment of outdoor water use. These procedures <br />will result in an administratable mitigation that will result in a net depletion to the Roaring <br />Fork River from users associated with 01CW305 of 0.005 cfs (2.25 gallons per minute). <br />Combined with all other BWCD contractees in this reach who have been included in <br />previous augmentation plans, the total depletion of the reach is 0.13 cfs. This total <br />depletion represents just 0.24 percent (0.0024) of the CWCB's decreed instream flow <br />right of 55 cfs. <br /> <br />3.2 CASE NO. 02CW77 -INJURY WITH MITIGATION <br /> <br />Water users that obtain a water allotment contract with the BWCD in the upper reach <br />subsequent to December 31, 2004 will fall under the District's "Umbrella Plan" as <br />outlined in Case No. 02CW77. The BWCD proposes a separate mitigation plan for this <br />case in exchange for the CWCB's agreement not to curtail those BWCD contractees <br />during a CWCB call. The BWCD's proposed mitigation for this case includes all the <br />elements of the proposal for case number 01CW305 (which elements are shared <br /> <br />12 <br /> <br />'10 ,'.
