The BWCD will contribute $5,500 annually to the on-going operation and <br />maintenance (O&M) costs associated with the gaging station for a minimum of <br />five years. The future payment obligation will be subject to Colorado law <br />regarding and limiting multi-year fiscal obligations. Failure of the BWCD to fund <br />the payment will suspend CWCB's no-call obligation. <br /> <br />3. If streamflow measurements within the upper reach during the period April <br />through September drop to 62 cfs (7 cfs above CWCB minimums), the BWCD <br />will: <br /> <br />A. Coordinate with the Division Engineer and CWCB to ensure that all junior <br />diversions affecting the upper reach are curtailed'. <br /> <br />B. Direct all District contractees located in the upper reach to implement water <br />conservation measures as described in the BWCD's water conservation <br />. regulation. Preparation and distribution of a Water Conservation Regulation <br />is part of the offered mitigation. The direction to conserve water will be <br />given to all contractees located in the upper reach, not just those associated <br />with Case No. 01CW305, and including contractees who divert at alternate <br />points of diversion to the Basalt Conduit. <br /> <br />4. If streamflow measurements within the upper reach during the period April <br />through September drop to 58 cfs (3 cfs above CWCB minimums), the BWCD <br />will direct all of its contractees in the upper reach to curtail all outdoor lawn, <br />garden, and open space irrigation and aesthetic/piscatorial pond filling. Again, <br />the BWCD will be restricting outdoor use on all contracts in the upper reach, not <br />just those associated with Case No. 01 CW305. <br /> <br />With implementation of this mitigation measure that includes all water users <br />within the upper reach, diversions within the reach will drop from an average of <br /> <br />. <br /> <br />I During dry year conditions It is most probable that the entire basin will be under administration after July <br />15~ due to the downstream Cameo call. Therefore, it is important that all Junior diversions are curtailed. <br /> <br />11 <br />
