<br />3 <br /> <br />12 <br />1 Reclamation Reform Act of 1982 (96. Stat. 1263; 43 <br />2 U.S.C. 390aa-390zz-1) and from any farm unit size limi- <br />3 tations established pursuant to section 4(c)(5) of the Act <br />4 of August 11, 1939 (Chapter 717; 16 U.S.C. 590z- <br />5 2(c)(5)): Provided, Jwwever, That in the event such non- <br />6 project water is commingled with project water in Rec- <br />7 lamation project facilities, and the resulting commingled <br />8 supply is used to irrigate lands in a project contractor's <br />9 service area, then such commingled water shall bear the <br />10 same acreage limitations or farm unit size limitations as <br />11 the project water unless- <br />12 "(1) contract provisions are in effect which pro- <br />13 vide that project or nonproject water, or both, will <br />14 be accounted for on a quantitative basis, that project <br />15 water will not be delivered to ineligible land, and <br />16 that appropriate charges, as determined by the Sec- <br />17 retary, will be paid for the project water, and <br />18 "(2) the charges for the use of the excess ca- <br />19 pacity include an appropriate interest component, as <br />20 determined by the Secretary. <br />21 "SEC. 12. Excess water. storage capacity in certain <br />22 east slope facilities to divert, store, impound, pump, or <br />23 convey nonproject water made available under contracts <br />24 executed pursuant to the provisions of section 8 shall not <br />25 be utilized so as to increase diversion of nonproject water <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />.UR 1714 1H <br />
