<br />"(bl For th~ conservation purposes of preserving or enhancing the <br /> <br /> <br />values of components of the National wild and Scenic Rivers System. dnd <br /> <br /> <br />environs thereof as determined by the appropriate Secretary, landowners <br />are authorized to donate or otherwise convey qualified real property <br />interests to qualified organizations consistent with subsection 170(hl(31 <br />of the Internal Revenue Code of 1954, as amended, including, but not <br />limited to, right-of-way, open space, scenic, or conservation easements, <br />without regard to, any ljmitation on the nature of the estate or interest <br />otherwise transferable within the jurisdiction where the land is <br />located. The conveyance of any such interest in land in accordance with <br />this subsection shall be deemed to further a Federal conservation policy <br />and yield a significant public benefit for purposes of section 6 of <br />Public Law 96-541.". <br />SEC. 311. Delete the existing section 14~ and substitute in lieu <br />thereof the following: <br />"SEC. 14A. Where necessary or deSirable to achieve the purposes of <br />this ~ct, the appropriate Secretary may sell "lease, permit or exchange <br />federally owned lands or interests therein,which are within or adjacent <br />to the boundaries or any component of the National Wild and Scenic <br />Rivers System: Provided, That such sale, lease, permit or exchange <br />shall be subject to such reservations, restrictive covenants, or other <br />terms and conditions as may be necessary or desirable to achieve the <br />purposes of the Act. In the exercise of this sale or lease authority, <br />the appropriate Secretary shall utilize the standards and procedures <br />provided at section 5(al of Public Law 90-401 including the provision <br />for a right of first refusal by the last owner of record.
