WHEREAS, a report entitled "Flood Insurance Study, Town of
Hotchkiss, Colorado, Delta County," which includes floodplain
information and data for the North Fork of the Gunnison River and
Short Draw, dated July 3, 1985, has been prepared by MSM
Consultants, Inc., under contract with the Federal Emergency
Management Agency; and

WHEREAS, said report describes and outlines the floodplain
data and information for the storm and floodwater runoff channels
or basins of the study area; and

WHEREAS, the Town of Hotchkiss has requested the Colorado
Water Conservation Board to designate and approve the floodplain
areas as set forth in the aforesaid report; and

WHEREAS,
requires the
prevention of

Section 37-60-106(1), Colorado Revised Statutes,
Colorado Water Conservation Board to assist in the
floods and flood damages therefrom; and

WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised
Statutes, provide that such legislative bodies of local
jurisdictions may provide zoning regulations for land uses on or
along any storm or floodwater runoff channel or basin only after
designation and approval by the Colorado Water Conservation Board;
and

WHEREAS, Section 37-60-l06(1)(c), COlorado Revised Statutes,
directs the Colorado Water Conservation Board to designate and
approve storm or floodwater runoff channels or basins and to make
such designations available to legislative bodies of local
jurisdictions; and

WHEREAS, the staff of the Board has reviewed said report and
does hereby recommend to the Colorado Water Conservation Board
that the Board designate and approve as floodplain areas those
