Conference Report to Accompany H.R. 2577
Making supplemental Appropriations for the Fiscal Year
Ending September 30, 1985, and for Other Purposes
(House Report 99-236)

The conferees (at page 49 of the conference report) agreed
to supplemental appropriations for the Bureau of Reclamation for
FY 85 as follows:

For an additional amount for the ...
Bureau of Reclamation ... for the design and
construction of the Animas-La Plata project,
Colorado and New Mexico; Buffalo Bill Dam
Project, Wyoming; Boulder Canyon, Arizona and
Nevada; and the Headgate Rock Project.
Arizona, to remain available until expended,
$l4,300,OOO; of which $1,000,000 shall be
available for transfers to the Upper Colorado
River Basin Fund ...: Provided further, That
none of the funds herein appropriated may be
expended to undertak~ such projects except
under terms and conditions acceptable to the
Secretary of the Int~rior as shall be set
forth in binding agr~ements with those
non-federal entities desiring to participate
in project construction. Each such agreement
shall include a stat~ment that the non-
federal entities are capable of and willing
to participate in project cost-sharing and
financing in accordance with terms of the
agreement. At such time as the Secretary has
executed a formal binding agreement and has
determined that the non-federal entities'
financing plan demonstrates a reasonable
likelihood of the non-federal interest's
ability to satisfy the terms and conditions
of the agreement, the Secretary shall
initiate construction at a project in
accordance with such agreement: Provided
further, That the funds appropriated herein
shall lapse on June 30, 1986, if the
agreement required herein for that projects
[sic] has not been executed.
