I think a meeting between the CWCB and the Authority to discuss this <br />matter is appropriate. I would suggest the attendees be you and Dan Law representing the Authority, <br />and me and Rod Kuharich representing the CWCB. Your suggestion of meeting in conjWlction with <br />'. this month's Colorado Water Congress' annual meeting would be.convenient for everyone. I will <br />have Rod contact Dan to make the arrangements. <br /> <br />In addressing your comments about the recent CWCB authorization of the Central Colorado Water . <br />Conservancy Distclct (Central) loan, I feel the actions by the CWCB staff were appropriate. The <br />2002 Construction FWld statutory revisions eliminated the CWCB requirement that "all other means <br />of financing shall be thoroughly explored before use is made of (Construction) fund moneys". This <br />change has eliminated the basis for the provisions included in Section 5 of the 1997 MOD. It is also <br />my Wlderstanding that staff members from both the Authority and the CWCB attend regularly <br />scheduled meetings of the Colorado Water and Sewer FWlding Coordination Committee at which <br />';mp "~"nopA lM~ n~pl;M':o-" are AJ's-us-ed COm' ce the CV"CB 's th- -ru'y TIl-nlber of the <br />~...u...... y......t'v.......u. .l.UUoI..1. ~t' u..a.1..I. .1.1"' \.l '" i) . ..:J vie U I c: 1 <br />committee that authorizes agricultural irrigation loans, the Central loan was not brought forward in <br />the committee discussions. <br /> <br />The Central loan notwithstanding, there are other sections of the MOU that have been rendered moot <br />by either recent legislation or by current practices of the Authority and CWCB. A discussion of the <br />merits of maintaining this MOU is therefore timely.
