Miller <br />Case No. 91CW201 <br />Page 3 <br /> <br />senior to November, 1991, the date of filing <br />of the application in this case. <br /> <br />(f) Applicant may continue to use his existing <br />exempt,coJnmercial well for the present <br />commercial development until the augmentation <br />plan approved in this case is put into effect. <br />The obligations under SUbparagraph (e) of this <br />paragraph shall take effect at such time as <br />the expansion of applicant's commercial <br />development requires him to apply for a new <br />well permit for the existing well or any <br />additional well pursuant to the decree to be <br />entered in this case. <br /> <br />(g) During each of the months October through <br />March, applicant's maximum consumptive use of <br />the water from the County User Pool shall be <br />no greater than .016 acre-feet per month. <br />During the months of October through March, no <br />portion of the water diverted pursuant to this <br />plan for augmentation may be stored. <br /> <br />(h) Water diverted pursuant to this plan for <br />augmentation shall not be used for snowmakin9 <br />purposes either directly, by exchange, or by <br />delivery through a municipal or domestic <br />system. <br /> <br />(i) Applicant's water rights formerly decreed in <br />Case No. 84CW306 may not be used at locations <br />or for purposes other than as described in the <br />decree in this case unless such use is <br />pursuant to subsequent court decree or <br />approved temporary substitute supply plan. <br /> <br />4. This stipulation is binding upon the parties hereto, <br />-their successors and assigns. <br /> <br />5. The CWCB shall remain on the mailing list in this <br />case and shall be provided with a copy of any proposed ruling in <br />this matter. The cweB agrees that it will not oppose any proposed <br />referee's ruling or decree that is no less restrictive on applicant <br />than this stipulation and that contains the terms and conditions of <br />the above paragraphs 3 and 4. <br /> <br />OATED this <br /> <br />day of <br /> <br />, 1992. <br />
