Requires that, prior to <br />completion of any annexation by a municipality within the 3-mile radius, <br />or within such other distance limit as may be agreed upon by the county <br />and municipality, the municipality has a plan in place that identifies any <br />territory within such distance limit for which the municipality may be <br />willing to entertain an annexation petition. Imposes certain requirements <br />with respect to the contents and updating of such plan, Requires any such <br />plan to be submitted to the county for its review and comment. <br />Authorizes municipalities to extend the municipality's boundaries <br />by more than 3 miles in anyone year pursuant to an intergovemmental <br />agreement between the municipality and the county, <br />Expands the ability of a municipality to monitor and challenge <br />nearby annexations from a one- to a 3-mile radius, <br />Grants municipalities dual oversight with counties in the creation <br />of new special districts within 3 miles of their municipal boundaries, <br />Adds new substantive criteria that local governments may consider when <br />deciding whether to approve a new special district plan, <br />Defines terms. <br /> <br />I <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br /> <br />Be it enacted by the General Assembly of the State of Colorado: <br />SECTION 1. Legislative declaration. (1) The general assembly <br />hereby finds and declares that: <br />(a) Regional land use planning would be improved with better <br /> <br />communication, coordination, and cooperation among and between <br /> <br />existing governmental entities, particularly local governmental bodies that <br /> <br /> <br />have traditionally and properly exercised their authority to plan for and <br /> <br />regulate land use; and <br /> <br /> <br />(b) Better planning and more orderly development is required in <br /> <br /> <br />fringe areas of existing municipalities where there is a critical need for <br /> <br />Reengrossed 1223 <br /> <br />-2- <br />
