Written Comments on Whether the Anti-Speculation Doctrine ApPlies within the
Denver Basin aquifers of the Designated Basins

At the next Ground Water Commission ("Commission") meeting, scheduled for On Friday,
February 22, 2002, in Room 230 (Hayes Student Center) of the Northeast Junior College, in
Sterling Colorado, the Commission is considering whether the Anti-Speculation Doctrine applies
within the Denver aasin aquifers of the Designated B::!sins, To assist the Commission in their .
decision with regard to this topic, the Commission Staff is soliciting comments from all
interested patties, '

The Commission's decision on this issue will be ill the form of a resolution and will finalize the
Commission's position with regard to the Anti-Sp~culation Doctrine's application within the
Denver Basin aquifers of the Designated Basins, The Designated Basins that this decision may
effect are the Lost Creek, Kiowa-Bijou, Upper Big Sandy and Upper Black Squirrel Creek
Designated Basins.

Please provide any written comments on this iSSlle tq the Commission Staff by January 28,
2002 such that the Staff may compile the comments and prepare a packet for each
Commissioner prior to the meeting. Comments should be limited to whether the Anti-
Speculation Doctrine applies, reasons for this COl'1clusion and what s'peculative test should be
applied, if any, Additionally, anyone preparing written comments should indicate whether they
would like to be present at the Commission meeting in Sterling for questions from the
Commissioners or to provide additional comments before the Commission
