<br />m <br /> <br />SECTION 593 <br /> <br />US Army Corps <br />of Engineers <br /> <br />Authority for: ENVIRONMENTAL INFRASTRUCTURE AND RESOURCE PROTECTION <br /> <br />WHAT CAN THE CORPS DO? Section 593 of the Water Resources Development Act 1999, provides the authority for the U.S, Army <br />Corps of Engineers to enter into cost sharing agreements with non-federal sponsors for publicly owned environmental infrastructure <br />projects within central New Mexico. Central New Mexico is defined currently defined as Bernalillo, Sandoval and Valencia Counties. <br />Under Section 593 authority, assistance may be in the form of design and construction for water related environmental infrastructure and <br />resource protection and development projects including projects for wastewater treatment and related facilities, water supply, conservation <br />and related facilities, stormwater retention and remediation, environmental restoration, and surface water resource protection and <br />Development. Project costs are shared on a 75% Federal, 25% non-federal basis. The non-federal sponsor receives credit for land, <br />easements, rights-of-way, and relocations toward the non-federal share of project costs not to exceed 25% of total project costs. <br />Additionally, the non-federal sponsor may receive credit for the reasonable cost of design work completed prior to entering into a project <br />Cooperation agreement; however, credit shall not exceed six percent of the total construction cost of the project. <br /> <br />WHAT ARE THE LOCAL RESPONSIBILITIES? Costs for Section 593 projects are shared between the Federal government (75%) <br />and a non-federal sponsor (25%) in accordance with the Water Resources Development Act of 1999. The non-federal sponsor must have <br />the legal and financial capability to fulfill project cooperation agreement requirements. <br /> <br />Formal assurances of cooperation must be furnished by the local sponsor. The sponsor generally must agree to the following: <br />. Contribute 25% of the project cost. <br />. Establish such legal and institutional structures as are necessary to ensure the effective long-term operation of the project. <br />. Hold and save the Government free from all damages arising from the design, construction, operation, maintenance, repair, rehabilitation <br />and replacement of the project. <br />. Once completed, assume 100% of the operation and maintenance cost. <br /> <br />HOW CAN HELP BE REQUESTED? We may begin a Section 593 project after receipt of a written request from the prospective <br />sponsor. A sample letter is offered below: <br />
