There is one decreed surface <br />diversions within this reach of stream (Tooker Spring and Pipeline). According to the DEO, <br />there is usually sufficient water available within this stream reach to satisfy the recommended <br />instream flow amount Based on this analysis, staff has determined that water is available for <br />appropriation on the North Fork Smith Fork Gunnison River, from the Headwaters to the <br />confluence of the North and South Smith Fork Gunnison Rivers, to preserve the natural <br />environment to a reasonable degree without limiting or foreclosing the exercise of valid existing <br />water rights. <br /> <br />-6- <br />
